    If it is okay with you, I am going to bring this matter to the attention of HMCTS Enforcement Operations. I will find out if it is Head of Enforcement Operations (North) or (South) to whom the matter should be referred. Collectica may have rendered the warrant invalid by obstructing/preventing you paying. Also, the court staff CAN recall the warrant at any time. You were incorrectly informed by the court staff.

    I may need to communicate with you off forum for security reasons as bailiffs are known to monitor these forums, especially if I have to prepare a submission setting out the case to HMCTS. However, we will address that at the appropriate time.

        Hi Milly,

        Update: Northamptonshire comes under HMCTS Enforcement Operations (North), which is based at Gildersome, in Yorkshire. The Senior Enforcement Manager (SEM) for Northamptonshire is based at Derby. I would recommend you telephone the SEM, on Monday, and see if they can bring sense to this made situation you and your OH find yourselves in before this matter is escalated to Head of Enforcement Operations level. The SEM's telephone number is 01332 362000

              Bluebottle........ I have today contacted the SEM for my area to bring them up to date on the situation. I was put through to the enforcements department and i was told that the SEM wasnt in this week and after a brief description of what it was regarding i was told that the SEM would not deal with this matter anyway. I discussed all the details of what had been goin on with collectica and the conversation id had with northampton court service and he just told me that a court issued distress warrant would never be recalled and my "vulnerability" is to be taken up with Collectica and is nothing to do with themselves. I asked if i could make payment to the court instead of collectica and was told, yes you can phone up and pay the £180.00 in full but collectica will still persue you for their fees (£215.00) and as it was sanctioned in court they will have the same rights with regards to collecting it as if it was on behalf of the court fine. I told him that i knew my rights and that i was unable to get collectica to agree to make an arrangement that was affordable to me and he said, they dont have to, they are instructed to collect the amount in full and do not have to accept instalments. He ended by saying, " I can get someone to call you tomorrow and they will tell you exactly the same as i have but i cant promise collectica wont take action overnight tonight" I said that i wouldnt let them into my property if they did turn up and he said that as it was a court issued distress warrant they had the right to enter by force??!!!!! Now im feeling sick with worry!! Please can someone help??

                  He wouldnt give me his surname, he didnt give me his job title......just that he worked in the enforcement department. Collectica phoned my OH shortly afterwards and told him that if he didnt agree to pay £35.00 per week over the phone tonight then a bailiff could visit, tonight or in the morning without notice and force entry to remove goods. I wasnt present at the time so my OH agreed to it. (d'oh).........Is there anything we can do now to get out of it?? Im adamant that i dont want to pay them........I tried everything. I mentioned everything as advised but the little jobsworth just kept telling me i was wrong and that collectica had more rights than most because is was a court issued distress warrant and it was for a criminal fine (tv licence). Its so infuriating.......ive tried to gen up on it as much as poss but they just dont take it!! I told the enforcement bloke that there was a high likelihood that we would come under the "vulnerable" thing and he said that was nothing to do with the courts, its up to collectica as to what they considered vulnerable and as the debt is solely in the name of my OH it wouldnt be taken seriously anyway as its MY illness and his debt. Obviously i argued this and said that i was aware of my rights and i was also aware that my illness would deem the household as vulnerable. Collectica told my OH that they did not do means testing and "pleading Vulnerability" wouldnt get us anywhere. Grrrrrrrrrrrrrrrrrrrrrrrrrrr!!!!!!!!!!!

                      I shall be speaking to the Senior Enforcement manager (SEM) for the Northamptonshire area tomorrow. It is clearly evident that Collectica are deliberately engineering a default in order to justify forcing entry and boost their fees. This sort of behaviour is unacceptable and, I suspect, illegal, also. If the SEM does not play ball, then the matter will need to be escalated to HMCTS at Director of Enforcement Operations level.
