    I would imagine that talking to either HMCTS or Marston Group would be like hitting your head off a brick wall. I would be tempted to try a complaint to your MP, playing on your health issues & possible financial hardship and see if that will elicit a different response.

      What I cannot understand is why some plod ticketed your vehicle when it was parked on a patch of private land and then claimed it was causing unnecessary obstruction. The offence of Causing Unnecessary Obstruction only applies if the vehicle is on a public highway, which includes the pavement. Could you tell us how your vehicle was parked, please, and whether it was obstructing a public footpath or a pavement bordering a public road.

      If it transpires the plod was bowing and scraping to some private landowner shouting their mouth off about a vehicle parked on their land - the "Get Orf My Land" brigade - the plod could be in a lot of trouble.

        Bluebottle, that is a plausible scenario, as if the motor was on some land adjacent to the pavement how could the pavement or highway be obstructed? Wasn't it Liverpool where the cops have no sense of humour?

          They have the same black, gallows sense of humour most uniformed coppers have, bb, besides their Scouse sense of humour. This sounds too much like a copper pandering to the "Get Orf My Land" brigade or a copper who's cocked-up badly. Then again, the OP may have been causing unnecessary obstruction of the free passage along the public highway.

            I will try and get a picture over the weekend to show you how my car was parked. I walk past this same piece of ground every day when I am in work and every day there is at least two cars parked there, never ever have I seen a ticket on one since receiving mine though! I am asked by my husband every day if I have managed to sort anything out with regards to his money, Ive never felt so low in my life, all for a £45 fine, that had it trebled would have been bad enough, I just cant understand how legally they can increase this amount by 500%, without any proper warning. Why are they not forced to send their letters, that they insist they have sent and I am damn sure have never been received, by recorded delivery, then of course I have been ignoring them, having said that, I think even then that their charges are proposterous!!! I can only in the meantime hope for the gent who called at my door nothing but what he deserves for the rest of his life.

              Have you contact Merseyside Police and asked them why they ticketed your vehicle and what evidence they have to justify issuing the ticket. If they can't and it turns out to be a bent or incompetent copper, expect a turnaround. They would have to go back to court and have both the ticket, fine and enforcement action quashed. That, I am afraid, is the only way you are likely to see your OH's money again.

                      This is a Fixed Penalty Notice and there is a simple way to obtain a refund and that is by completing a Statutory Declaration. If accepted this will revoke the Distress warrant and you will be entitled to a full refund of all monies paid under the warrant.

                      However, such applications may only be made in cases where the person not received the original notice on the car or by post. Did you receive the notice on the car?

                          So, if I just write to merseyside police and explain the situation then? If I were to enclose a few photos of the cars that are parked on there daily and dont get ticketed would that help my case at all?? My OH and myself have now seperated, as I figured would be the outcome! This was basically just the straw that broke the big fat camels back!! Life goes on but would still like to get him his bloomin money back!!
