    Ang,

    It is very important that you scan and post up the letter you received from "Merseyside Magistrates Court" asap. I have just run a check on the Ministry of Justice website and there is no "Merseyside Magistrates Court" listed.

    The only magistrates courts listed for the Merseyside area are -

    Huyton
    Knowsley
    Liverpool
    Liverpool & Knowsley
    Southport
    South Sefton
    St Helens
    Wirral

    but no, repeat, no Merseyside Magistrates Court.

      For whatever reason it seems as if the Police have ticketed the car. From your brief description of the letter you had back in january this sounds a lot like a Further Steps Notice was issued. Although you say you destroyed the original ticket did you ever get notification the unpaid ticket was going to Court. I think you may need more details from the Court as to me it sounds as if you were given no time before they have escalated this.

          I have posted both pages of the letter and also the receipt the guy issued on Monday morning. If there is no merseyside magistrates, who is it I spoke to on the telephone? I begged this woman to refund the payment but she refused, when she thought I had hung up she said to her colleague 'she wanted her money back, well, SHAME!' nasty individual.

          This is the only documentation I have regarding the fine, I have told them that their letter they insist was sent on 29th January has not been received but they dont really care.

            My view of what you have.

            The Collection order I believe to be genuine. The address used probably is a generic one for communications etc. From what I read of it the offence was initially committed on 29/10/12 by Fixed Penalty Notice and because it wasn't paid was commuted to a Fine on 4/12/12. The assumption is that at this point you would have been advised this happened. As no payment again was received you have been issued with a Collection Order whereby it gave you until 23/1/13 to pay, the terms of the Order say if no payment is made then x, y or z may happen as listed which would be the terms listed as a Final Steps Notice. To me it appears that the Collection Order also serves as the Final Steps and you are now where you find yourself in which case I think you have to take it on the nose as it looks as if everything has been carried out correctly.

            I appreciate this may be not what you wish to hear but I can only speak as I see things.

              What we do not have is the name and badge number of the scuffer who thought it would be big or clever to issue a Fixed Penalty Notice to a driver with a disability, on the preposterous grounds that her vehicle was "obstructing the pavement".

              In my opinion, he should be made to pay the £346 - before he was permanently assigned to school crossing duty.

                  I have just come off the phone to the Ministry of Justice and H.M. Courts & Trbunals Service. It would appear that the Collection Order is genuine and valid. The "Merseyside Magistrates Court" is actually the Cheshire & Merseyside Enforcement Office for HMCTS. In those respects, the paperwork is in order. However, the actions of the Marston bailiff leave a lot to be desired and, possibly, the actions of Merseyside Police. It will be a case of the OP posting up further details of the incident so that it can be determined whether the police officer involved should be referred to as "Officer" or "Tithead".

                    Would this be as in pillock trying to make a name for themselves as as Jobsworth, the kind who snoops round the Police Office car park checking colleagues motors for minor defects? Have come across some of them before.

                        Does this then mean that there is no way to get my husbands money back?? We just cant afford to part with that kind of money, my husband had to use his credit card and now we will have to make payments to that forever!! As I said, I am in an IVA and every penny is spoken for each month. Had I of had to go to court I could have proven all of this, I could have made a payment agreement but it would have been minimal payments due to the IVA. Do I have any way forward using the disability aspect? I have a very high pressure job and low performance results in dismissal so I just cant afford to be this stressed, as pleasant as the staff at the priory were, I really dont wish to return, not when everything was beginning to get back to normal. Now the relationship between myself and my husband has now become very strained to put it mildly, to the point where I am seriously considering moving out as I just cant cope with all of this anymore :'(
                        I do appreciate all the trouble you guys are going to in trying to help me x x

I cant understand how through my illness, that I dont pay attention, this has landed me up with a fine increased by 500% it just cant be right, there has to be something I can do........ isnt there??? :'(

                                Sorry to say but the money is unlikely to be returned by marstons more likely another fee will turn up
                                i feel for you with your problems monetary and other but from reading hundreds of posts on here about marstons they care for no one its just money
