Exactly, it would, but my point was that they are possibly stupid or greedy enough to try to charge a third party to a debt fees for a levy wrongfully applied to their car.

In another thread on here, there is a case of bailiffs from Philips enforcing a £850 motoring fine by extorting an astounding £1900 from the miscreant's grandparents!

All this is indicative of bluebottle's stand point shared by many on here that private Certificated bailiffs have no place in HMCS, fine collection, and really are part of the problem not the solution of civil debt collection

In Ruburoo's case here, the brainless and Stupor bailiff is well out of order, I wonder if he checked DVLA and levied anyway, hoping that Rubyroo would not question the fee and pay up anyway? The council should be made aware of their bailiffs propensity for potential fraud, and that as they are liable for his action, Busted & stupid bringing the council into disrepute. I wonder in cases where the council support their bailiffs in their unlawful charging and dubious actions that are at vasriance with what is stipulated, and they have been informed of the wrongful actions, that if they carry on, leveling charges of Misfeance In Public Office at the council officials would be an option?

We have found out our council tax arrears have been passed to this company £2500 Benefit overpayment and we had a payment plan in place but my partner missed 3 payments and only found out today they had done this. She tried to call there office to arrange a payment plan but the snotty women on the phone said she could only do this when the bailiff was at our home and to just let him in and he could sort this out. She went through all our income ( I get JSA and my partner gets maternity allowance ) and said she would pass this on to the bailiff before he visits.

I have said there is no way I'm letting him in and I want to go to the council to try and sort this mess out, as they never sent us a letter saying we owed any payments and would be passing our account on. Can the council refuse to take our payments back or do we have to deal with this company.

There is no way we can afford to pay this off in one go and the maximum we could afford is £100 per month, I'm just scarred they are going to take all our thing to pay off the debt.

You do NOT have to let the bailiff in, prevent him gaining a levy, and his powers are limited, and as you are on JSA and your partner either is pregnant or has a young baby you are potentially vulnerable under the national standards,

1. Nothing in law says you have to deal with a bailiff;
2. A bailiff has no power of entry without a court order signed in ink by a judge or has previous obtained a valid levy;
3. Brainless & Stupid are talking out of a certain bodily orifice at the lowermost point of their alimentary canals;

Exactly, if they do get the numpty on the desk refusing the payme4nt to sign a piece of paper indicating they will not accept your payment, that is evidence of the council UNLAWFULLY refusing a legally tendered payment, which can be used in a Formal Complaint later.

Yes they could be the product of Levi Strauss, or alternatively Distress Levied on goods in a walking possession, ie the goods are seized and listed on a Notice Of Seizure, but remain with the debtor, if a payment arrangement is kept, also allows bailiff to be creative with fees if he gets one, not all fees are kosher though. he has to get in to levy, but may seize a car any car and hope you are the owner.
