Also, Rule 52.2, Criminal Procedures Rules 2011. This clarifies the position of not proceeding with enforcement until the defendant has been served with an FSN. However, non-receipt of FSNs is not an isolated matter. This is beginning to follow a pattern and become a regular occurrence. It would not be beyond the realms of possibility that the FSN is being put on the system, but the FSN is not being printed off and posted to defendants.

The AEM acknowledges in all probability the FSN was not received by me as according to their records it was sent to me on 04/01 to my previous address. However simply putting it in an envelope and posting it constitutes being served as far as the fines office are concerned.

I agree that rule 52.2 states a FSN must be served, how can you challenge the validity of a warrant if you have no redress to the court who issued the warrant. When as far as I can see the warrant is issued by a civil servant and has never been into a court to be validated.

Can you apply to the high court to be granted an injunction?

not if they sent it to a previous address I don't think, but other Beagles will be more certain. I think the fines office are speaking via their anal trumpet.

The only way to get this sorted is to refer the matter to one of the Heads of Enforcement Operations at HMCTS. If they won't play ball, then the next level up is Director of Enforcement Operations and, ultimately, CEO of HMCTS.

Number the paragraphs and put events in chronological order, making it clear what HMCTS has done and what they haven't done. FYI, the Head of Enforcement Operations (North) is not in Manchester, although the Senior Enforcement Manager for the Greater Manchester area is. A Head of Enforcement Operations is more senior in position than a Senior Enforcement Manager.
