my thoughts exactly, the area officer is well aware of the way they act but refuses to know anything, absolute rubbish as its him to instructs them to collect the fine

A sad reflection that even where the arbiter should be justice, due process and procedural fairness, they adopt "The end justifies the means" as a status quo. This makes them no better than any criminal, or pseudo criminal, in the case of TV licence, that the system judges guilty. they are as bad as in extremis, as the Krays Richardsons, or from over the pond the Mafia. Marstons bailiffs are sometimes as bad as members of those gangs collecting protection money even unto death as in Fleetwood, in their pursuit of a debtor.

A marstons bailiff called on him and virtually frogmarched a pensioner to a cashpoint, and he had a heart attack near the ATM, he had not long partially recovered from a stroke, and a coma which had followed heart problems:

HMCS blood on their hands? The stress killed him as surely as if Pierrepoint had strung him up, and opened the trapdoor,

Still, "Jumping" Jack Straw launched an official investigation - so that makes everything hunky-dory again, doesn't it?

Are you having a laugh? :madgrin::madgrin::madgrin: Jumping Jack Straw, wanted a whitewash, and got one, the current incumbent, is no better, in fact they want to give these Certificated legalised burglars more power and opportunity to profit from someones misfortune. I would impose a Sharia punishment on these bailiffs who defraud a debtor, as per what they do to thieves, in an Arab country.

Of course, because that is what an "official investigation" is meant to do.

Only the naive believe that "official investigations" take place to dig up the truth; the reality is that they are conducted to dig the truth in or, in other words, to bury it.

I'd go with that for a joint venture stall selling the rotten fruit and vegetables for the public to pelt them with. After all, the spare meat may find it's way into the pies, if they used amputation, so your solution is better on reflection.

Of course one should point out that in this case, while it was regarded, rightly, as very serious, the bailiff was found innocent of any wrongdoing I believe. It did of course attract a lot of unwanted attention by Marstons - not the only time such attention has been attracted by them in the past either. I'm sure 2006 rings a bell over something very significant as well.

One can't help but wonder as Drakes had built up a certain reputation, and John Marston Ltd was a highly respected, small, bailiff company, whether perhaps some of the less desirable traits from what used to be Drakes have now spilled over into regular practice in Marstons since Drakes took over the company?

Possibly coincidentally, one might also wonder if by Drakes buying out John Marston Ltd, they bought the good name established by JML and used it in order to stop themselves being forced out of business?

No i would say right on the money, looking at what happened with Drakes, they had no choice but to phoenix by taking over and changing their corporate ID to marstons, looks like they took the Drakes methods with them and implemented them at marstons though. Time for them to be wound up as suggested by bluebottle?

When having problems with enforcement agents acting on behalf of HMCTS, the complaint route should be -

HMCTS Area Enforcement Manager (AEM) -> HMCTS Regional Contracts Manager (RCM) -> HMCTS Enforcement Operations Department

If a complaint gets to the level of HMCTS Enforcement Operations Department, I would recommend that the complaint is addressed to the Head of Enforcement Operations (HEO), stating where you are in England and Wales, as this will determine which HEO deals with it.
