    I had dealings with the solicitors you name some years ago..totally unrelated to anything debt/charge wise, the reason I make mention is they were shall we say very' inept' (Cleverclogs will quite likely be able to define 'inept' for you far more eloquently than I "evil2") File their letter under GS

        Graham White solicitors probably never sent the supposed letters about their clients Roxburghe. It is far more likely that these letters were printed on the same threatomatic Mk II that the letters fro Roxburghe were printed on. The clues will be there (barcodes, minute ref numbers, QR Codes etc)

            My final letter, albeit from another PCC, stated they were taking court action (not may take, were taking) - that was the last I heard of them. If they are, their solicitors are moving rather slower than a snail.

            It does sound as though you must be near the end of the letter chain - please keep us posted.

              The attached file, though merely a County Court judgement and hence not stare decisis, may be helpful.

              Nearly two years ago, the Office of Faffing and Twaddling stated that they were "minded to revoke" the licence held by Roxburghe - link

              Can anyone explain how the OFT is "fit for purpose".

                The judge sussed out those comedians it would appear that this parking firms would be unwise to take anyone to court they may come up against hopefully someone who will take them through higher courts and shut the monkeys down end of one set of threatograms

                    What a shame that was in the County Court CC - MANY thanks for posting up the pdf - I hope you don't mind my saving it. There were a couple of issues which swung the case, the main one relevant for a general rule being the fine was a penalty. What surprised me a little was that the judge considered there was a contract formed - that's an argument which has long been used against these (and still can be with it being the county court here), but one worth bearing in mind in future. If one judge can draw that conclusion, so can another.

                      All these parking and private PPC tickets rely on the law of contract and need a CCJ to enforce, if it is a case of an overstay in a FREE car park, and they want £80 for an overstay of a few minutes oer whatever, they can only sue for consequential loss, which in that case would be zilch, even i a pay car park it could be pennies, so the disparity between the loss, and the Penalty, means they would and have been laughed out of court

                        If you read this bb - it's a good read - the judge goes through the stages of contract formation and summises that a contract has been formed. It was dismissed for other reasons.

                          I( think in many cases even though a contract may be deemed to exist, the charge is obviously a penalty so it would fail on that.

                            Indeed, and that is the reason that concerns our stance on these things. The other issue was to do with signage which obviously would vary from case to case.

                                Roxburghe, and Graham White, along with Michael David Sobell, are names well known in the murky world of the Private Parking fleecing schemes, whare they try to bend the law of contract around itself to justify an unlawful contractural penalty.
