  • Jocobs bailifs

    i have a problem with jacobs bailiffs - i had parking fine which was going to old address as i forgot to change registered address - the person who lives in my old house finally give me the letters 8 months later i phoned the fines office and they said its been passed to bailiffs.

    So i phoned jacobs - they said its now with a bailiff and give me his number - i phoned him up and he said he would take my details and phone me back - nothing for 3 months - i have now had a letter and a phone call saying i must pay £263.44 in next 24 hours or "removal of goods" will take place...

    What is this and how has it got to this stage without any contact from jacobs to myself.

    Now i can pay the 263.44 but want to pay by cheque not cash or card. I neither trust them with my card details and im certainly not paying cash - but howh has it gone from 120 to 263.44 ?

    any advice on this would be great - do i have to pay in full - is this removal of goods right ? do the charges sound right ?

    I dont have much dealings with bailiffs so im new to all this.

      how has it got to "removal of goods letter" can they just come and demand the money one day and remove goods the next ?

      and as this ticket was going to old address - can i issue a stat declaration form (out of time)? to get the fine back to the fines office and pay it there?

        Phone the TEC as per the link. It explains what will happen. I doubt you'll see bailiff tomorrow. They have to have levied and have an order from the court to force entry. You want to stop them levying on anything till you've done the TEC bit, so may be worth parking your car a short walk away for a few days.

          Follow Labman's advice first. If the paperwork was going to your old address, the bailiffs would have to inform the LA that issued the PCN and get the address changed on the warrant. It sounds like the bailiffs may have been engaged in something called "Data Cleansing", changing details on the warrant without lawful authority, which is illegal. They are supposed to return the warrant to the LA, who then apply to Northampton TEC to have a new charge certificate issued and they then issue a new warrant with your new address on it. However, unless the bailiff has a valid and lawful levy on any of your goods, the "Removal of Goods" Letter is a scare tactic. There are strict rules governing distress which prevent bailiffs from levying on and removing goods on the same day. However, many bailiffs seem to conveniently forget these rules exist.

          Golden Rules of Dealing With Bailiffs

          Number 1 - BAILIFFS LIE
          Number 2 - AS NUMBER 1
          Number 3 - DO NOT LET THEM INTO YOUR HOME UNDER ANY CIRCUMSTANCES
          Number 4 - KEEP ALL DOORS AND WINDOWS CLOSED AND LOCKED
          Number 5 - NEVER BELIEVE ANYTHING THEY SAY
          Number 6 - RECORD/VIDEO EVERYTHING THEY SAY AND DO
          Number 7 - MOVE A MOTOR VEHICLE WELL AWAY FROM THE OUTSIDE YOUR HOME

            my vehicles are sign written works vans but the missis has a corsa but i am not the owner of that ? so do i really need to move the cars and vans ?

              thanks for the info i really appreciate it. I have the means to pay this but i just dont like the way they have done it. and im not the type to be bullied into anything.

                Jacobs attempt to seize signwritten business vehicles and third-party private vehicles at their own peril. Jacobs seized a third-party vehicle sometime ago and it cost them a pretty packet, as they had to recover the vehicle from the mug who bought it and pay compensation to them and the lawful owner of the vehicle on top of that. It was a very expensive lesson for Jacobs.

                  Technically the sign-written ones should be fine as they are clearly tools of your trade. Your wife's Corsa is a different kettle of fish though. Again technically it shouldn't be seized, but I would not lay money on them not doing so.

                    she is my partner - not my wife - completely different names and she owns the car outright - i dont know if that makes a difference or not.

                    Today i had a discussion with him on the phone

                    he has made one visit to the property and what started at 138 is now 263.44 does this sound right ?

                      In that case, Jacobs cannot levy on your partner's car at all. Could you list the charges Jacobs are listing, please? Like another bailiff company, Equita, Jacobs can be somewhat "creative" with their accounting.

                        They're supposed to check with DVLA first, but often don't. It is a regular occurence to see neighbours' cars clamped, so hers still could be. She'd have to show the log book and they'd remove and clamp - ideally she should then seek compensation if it happened.

                            Certificated bailiffs are habitual liars - it is in their DNA. However, sometimes, their lies catch up with them, as happened at Hove Crown Court just before Christmas. Two certificated bailiffs are now crapping themselves as to what is going to happen next. The judge who heard the case was the most senior Circuit Judge on the Criminal Circuit for that area and he was having none of it.
