    hi my name is donna,
    i purchased my car of a private seller and had the car parked outside my house for no more then 3weeks, one morning i woke up to see that the car was gone ...

    i phoned the police straight away and was later told that the car has been taken my bailiffs jbw, i never had no tickets prior on this car or my previous car so was in total shock when i heard this i rang the company jbw who told me that that car was in the previous car owners name and that was the reason it was impounded, i told jbw that i have purchased the car way before it was taken from my house and that they advised me the only way is to prove v5 logbook.

    at this particular time the logbook still has not come for which i rang dvla for them to tell me that they have not received the logbook and they insisted that this may be due to the olympics and a interruption with royal mail, i told dvla the situation for which they advised me to go the the borhemwood dvla and fil out a v62 and that that should be good enough to take out the CAR out the pound

    I THEN sent the v62 with insurance documents and the receipt of purchase to jbw (for which they requested for me to take out the car) to turn around and say they dont accept this that they need the full v5 documents ... at this time i am furiose at the fact that they have been messing me about...

    now i have logbook and jbw are now turning round and saying that the legal team will investigate and give me an answer its been soo long for me waiting on my logbook for it to come and for jbw to tell me that its been investigated i find this very stressful and consider this as theft as jbw are not giving my property back and using stupid theories about a v5 logbook not be proof of ownership... is there anyone out there that can help me or advise me as i am fully stressed and stuck for which i am not sure what my next steps are

    You bought the car and sent off the old V5. You have insurance and a (presumably dated), purchase receipt.
    Before the new V5 arrived, JBW took the car.
    You queried the non-appearance of the new V5 with the DVLA and they cited postal delays as a possible reason.
    At the DVLA's suggestion, you filled out a V62. This was then rejected by JBW.
    You now have the new V5, but JBW will still not release the car until they have 'investigated'.

    Establish exactly when the DVLA database was changed to show your ownership. If the car was registered in your name at the DVLA and JBW knew this when they took it, that would be theft. If they failed to check current ownership, that would be negligence and you could claim against them. You may also have a claim if they take overlong to resolve the matter.

    Write to them (never deal with them on the telephone), Recorded Delivery, setting out the facts. Give them a deadline to release the vehicle (they don't need to 'investigate', you have a V5 and a DATED purchase receipt). Make it clear that you will take legal action if they don't get get their skates on.

      Have requested the site team to delete your other thread sinces its a duplicate of this one, that way all advice will be confined to this thread.

      I will post some advice for you later or in the morning, just bit preoccupied at the moment. But don't worry we'll get your car back and force them to compensate you too. They are talking crap and they know it!

        You need to remind JBW that the Warrant of Execution they have been asked to execute is for a different name at a different address. I would also inform that following your provision of the documents you will now be charging them for any expenses you incur - car hire, phone calls, your time, any other expense you can come up with and if the car is not returned within 48 hours will also bill them for the full value of the vehicle. JBW have form for this type of thing.

        Have they told you which Council this is on behalf of as they also can be held 100% liable.

          Thank ou very much i will chase them down and tell them everything you have said, i have noticed that they like to put the phone down when they cannot answer a question. And yes i am aware of the council and will contact them as well thanks :tinysmile_kiss_t4:

                When you say Council, have they told you what the Council debt the last owner owed?
                Was it unpaid parking fines or Council tax
                Also! how far away do you live from the seller? the reason I ask is how did they find the car at your address and not the original owner

                  hi yes they would not give up any information on the previous owner or debt but contacted the previous owner which said that it was congestion charges and that he was not aware himself and the car was taken from a van with ANPR system camera on it and was just diving around which picked up my car and license plate outside my house early hours of the morning
