    If they gained entry then I don't know how as no one was in the house but no list was left or signed by me or anyone else ?

      I ahve asked for a break down of fees but was told it would cost £140 to which I think they are a cow boy firm ?

        It is a legal requirement that a Notice of Seizure be left if a levy on goods is made. No Notice of Seizure = No levy = No Associated Charges

          Load of cobblers, use Letter 1 from http://www.legalbeagles.info/forums/...Useful-Letters . Send initially by email if you can, followed by a copy in the post. They are obliged to provide this if requested - free of charge.

            They MUST provide a brweakdown of their fees free of charge on request, what bailiff company is this?

              If this is for Council Tax have checked to see exactly how much the Liability Order was for as confirmed by the Council? Have you checked to see that the Bailiff holds a current Certificate allowing him to collect? Can you tell us which Council & which Bailiff Co?

                What about the council's court order of intent to seize items, as outstanding debt has been paid in full 12 months ago, as who ever is trying seize these items is trying to use the council's court order to obtain access for there own purpose of which as I understand no judge in England would back as the court order was issued for the councils own purpose to gain funds and there own council costs and not bailiffs fees ? As a court case in 2009 the judge ruled between JBW ltd and West Minster council saying that the bailiffs fees was a civil matter and not a court order matter in other words the bailiffs would have to start a fresh court case to gain there fees ?

                  The council is Derbyshire Dales District Council and the debt was £800. Bailiffs no idea as no paper work and I will have to wait untill Monday to ring the council up.

                    You need to speak to someone at the Council and ask the following questions:
                    1 - how many Liability Orders they have against you
                    2 - the dates they were obtained
                    3 - the addresses they were for
                    4 - the period of time each covers
                    5 - how much each one was for
                    6 - how much is still outstanding
                    7 - the dates they were passed on for enforcement
                    8 - the dates & amounts of any payments

                      Thanks for the advice as going to work now at the moment there is no liability orders against me from council as up to date with payments but will ask who bailiffs were.

                        With Liability Orders for Council Tax the Bailiff Fees are deducted first with any balance going to what you owe the Council. For example if you owed £500 & paid the Council this after the Bailiff had been demanding his lawful fees of £42-50 then in actual fact you have only paid £457-50 off what you owe and the Bailiff may still enforce against the rest.

                        However not all Councils pay the Bailiffs their fees and you will need to ask if this is the case with your own Council.

                          just to put a smile on your faces bailiffs paid us a vist at 9.45pm on friday only we left the door open and as soon as they knocked on the door the Great Dane, French masfit and Jack russle ran out and surronded them so I suspect when they return again they will be in numbers ? !!!!

                            Just keep the door closed, but then they should not call after 9 pm, after all you could have thought they were burglars that time of night, if it had been me at that time they would have met Mr B Bat, as only a thief would be around where I live that time of night

                              Be careful they don't allege you did this on purpose or you have "dangerous" dogs on the premises.

                                Good advice ploddertom, but if it is getting around 10 pm then arguably bailiffs shouldn't be snooping around, as at that time of night it could be they iwho end up n the back of a police van, plod tends to arrest anyone prowling around a premises or garden at that time of night if they are called. Well they do around where I live, they have even been known to Taser the intruder
