    Good Afternoon Labman

    ive been reading some of your responses to various complaints against Bailiffs and iv got one against Bristow and Sutor, Maybe you can cast your eye over it.
    they called at my house and spoke to my girlfriend to collect a debt in total of £18970. This was for various council tax and NDR, however i have disputed 17,000 of it and sent the council proof that this is not owed by me but to a company that is subsequently gone into Liquidation and have a signed tenancy agreement with the company for the period they are chasing for.

    first of all he was not invited into my home, me and my family are wise enough that this will never happen and my house has been modified to cater for un wanted guests ie BAILIFFS. He asked my girlfriend for immediate payment which i don't know what planet these people live on but what a ludicrous request!!
    he went onto to ask whose car was it parked across my drive on the street and whose caravan was on my drive, she replied neither items belong to us. He went onto levy against the items but failed to check the true ownership of the vehicle which stated in by the Local Government Ombudsman, it is the councils responsibility to ensure that the appointed bailiffs carry out a vehicle check prior to putting a levy against it. They have had a very stern letter off the owner and one proof of the owner of the caravan, so they have no Goods to levy against.
    i spoke to the bailiffs office to tell them that the debt was in dispute and like i suspected they wasn't interested only that the debt needed paying in full, no questions. I then went onto speak to the council and the bailiff liaison officer. I made a request for a payment arrangement of £500 per month to clear the balance i believed is actually owed, a reasonable request some would say. He told me ive lost my right to do this and it must be paid in full or the bailiff has the right to enter my property and tale my goods which we all know is rubbish.
    the bailiffs fees are also incorrect because he has charged me for 2 visits when its in fact 1, 6 levy charges when he hasnt done the relevant checks of ownership and charged me again for a first visit so 3 visits in all. I know that this is classed as fraud when this happens and due to the way this has been handled and my Love and passion for Bailiffs, sorry Hatred towards this low life rats, what would you consider my next move should be.

    i have:

    emailed the council with relevant documentation regarding the discrepancy
    emailed the council the points spoke about and there un willingness to make accept a payment arrangement.
    documentation regarding true ownership of the items they levied against
    and emailed both parties what will happen if goods are removed, will call the police

    What would you do next??

    You need to speak to someone at the Council and ask the following questions:
    1 - how many Liability Orders they have against you
    2 - the dates they were obtained
    3 - the addresses they were for
    4 - the period of time each covers
    5 - how much each one was for
    6 - how much is still outstanding
    7 - the dates they were passed on for enforcement
    8 - the dates & amounts of any payments

    As far as the Bailiffs are concerned only ring them if you can record the call - they do have selective memorie. You should also send off for a breakdown of the fees they are charging use letter 1 from http://www.legalbeagles.info/forums/...Useful-Letters & send initially by email followed by a copy in the post enquiries@bistowsutor.co.uk

      Thank you for your reply. I do have a breakdown of fees and on them it states 24.50 for first visit, 24.50 again for a first visit and then 24.50 for a second visit which this is his first one. the liability orders are 6 in total. there is also 6 Levy fees totalling £600 and a walking possession fee of £127, he never entered my home. However, 2 are disputed and are not owed, 1 i have paid off and the council have acknowledged this. I called the bailiffs so i left an audit trail for later, this was so all parties knew my requests and i knew what there answers would be. i will not be calling them again, email from here on in. Thanks for the templates, very useful. What do you think should be done regarding the breaking of protocol in respect of the vehicle?

        As far as him levying on a vehicle or other goods that do not belong to you, yes he may do a simple DVLA check for a car but for other goods this is not possible. The person who owns the goods should claim ownersip ASAP by providing the relevant documents. I also not from what you say he appears to have made multiple charges for what appears to be a single visit. Does the breakdown you have a list of dates when all this happened? Has he listed the same goods on each levy? Has he left a Notice of Seizure for each?

          he has listed 6 levy fees in total, which the owners of the 2 items have sent proof of ownership to the bailiffs and they have taken them off the seizure, also i have read many claims in which the bailiffs commit fraud when they overcharge and the council are held accountable when the bailiffs dont check vehicle ownership prior to doing a levy, this is set by the local government ombudsman. the list of charges apply to 1 single visit which was last Wednesday yes he has left a seizure notice.

                  There appears to be a page missing - the one that says "Once upon a time".

                  Seriously though he charged fees of £440 in total. If he attended with them all together then he must treat them as one. He is claiming to have levied on the same goods 6 times - another no no. He has also charged a Header H Fee - again as no goods have been removed then he cannot charge this despite anything they may say.

                  Have the Bailiffs acknowledged & accepted that you do not own either car or caravan, if so then they must remove all levy fees & associated charges, they must also remove the multiple visit charges and replace them with 1 charge of £24-50 that covers the whole lot.

                  Have they been back since the "alleged" levy was made? I tend to think you may have upset his plans for expensive Xmas presents this year.

                  Obviously you have issues with the Council and the Bailiff is only carrying out their instructions so for this he cannot be blamed unfortunately. You do need to address these as a matter of urgency.

                      in Post 2 I suggested you get the details from the Council - this still applies. I would still send off for a breakdown of the fees from the Bailiffs, I know what the Bailiff has left you but sometimes the "office" will add or subtract items. Once you then have everything we can plan for what to do.

                            Ive attached the letter for you to read. They have already wrote to the 3rd party owners of the 2 items they levied on and have said they are no longer of interest to them so they have no goods levied.

                            also i have supplied evidence to the council regarding the discrepancies with the order which ive had no response to which amounts to £14623.85. The council have already received 2 payments from me as I told then i would pay and the cheques have been cashed which is for £375.36 and £947.20 so the only debts i say is outstanding is £1381.75 and £1094.27 which i told the council i will pay £500 per month starting January.

                              Well that seems to be an about turn, there appears to be only one set of fees in there now. You will need to start a dialogue with the Council over what you dispute.
