i arrived home from work Friday evening (23rd) to a Marston's letter dated 21st Nov stating the company was in possession of a Magistrate's Court order for non payment of a fine of £360 and that my residence at my address had been confirmed. This was the first I'd heard of an offence, or a fine.The nature of the offence, nor the location of the Court were stated.
I spoke to Marton's helpline twice.
First time the chap refused to tell me which Court had issued the Client Ref number on my letter, saying Marston's didn't get involved in disputes. He did say it was for an offence in Nov 2011, for a pedal bike fine. He asked for my date of birth, which I gave, since I wanted to discuss the case. I didn't give a mobile number.
I rang again and a more pleasant woman did tell me that it was City of London Magistrates Court. She again asked for my date of birth. I told her I had no knowledge of any offence, nor had seen any notifications from the Magistrates Court. She suggested that the court would tell me that Marston's were dealing with the fine and not much more. However, I really will need to find out what is the offence, in order to complete a Statutory Declaration before 7 days. She stated my old address (I lived there from 1992-1998). Looking at the City of London website there is advice to contact City of Westminster which I will do on Monday.
I will be surprised if the fine does apply to me since I don't have a bike and have never ridden one in London. It also occurred to me that I was in plaster for most of November last year, due to a fractured foot. I'm very surprised to know nothing about the case through correspondence with the Court (I have been living at the same address for 12 years).
I would have expected the location of the Court and the nature of the fine to be on a letter demanding £360 and the whole business leaves an unpleasant taste in the mouth. Perhaps something has happened - but I am now going to be trying to find out about a case I genuinely know nothing about, in order to prevent the possibility of bailiffs arriving and breaking into my home.
