    Hi yesturday i noticed a removal notice threw my door from MR C at Marstons enforcement. They said they called in the afternoon at 1.55 which is untrue as i was indoors allday, it had a mobile number to contact MR C which i did try several times to no answer , i tried this morning and got a answer machine left my name an number, anyway he did call me bk some time later i was polite and asked what the letter was about which was for no tv license in 2011, amount 586.00 he was very nasty not atall helpfull i said about installments to pay it off he just said pay in full and hungup, just received a text from MR CARLTON sayin he is coming to break entry to my house under 4a domestic violence crimes and victim act to remove my goods i have never had a letter before this one from Marstons which they say i have and also he claims he has been to my property many times. I have tried to Phone this man bk but he just keeps rejecting my calls. I only want to pay installments my income is j.s.a due to recently being layed of work ? what do i do now he says he coming bk with locksmith and van . Thanks Nickola

    Hi Nickola,

    Firstly, can I suggest you remove the bailiff's name from the above thread.

    Would I be correct in assuming you are a single occupant of the house?

        DODGY BAILIFF ALERT

        I've just run a check on the bailiff named in Nickola's post and he is showing as Not Registered. I will send an email to HMCTS about this over the course of the next couple of days. If he is not registered, that will be the second Marston Group bailiff acting on behalf of HMCTS who is not registered.

        He cannot break in without written authorisation from a court and such authorisation is rarely given, except in cases of persistent avoidance. Save the text message Mr Brain-Dead Bailiff from Marstons has sent you as this can be used against him as evidence of sending a threatening communication, which is a criminal offence. HMCTS do not take kindly to this sort of behaviour. You may need to speak directly to the Area HMCTS Enforcement Manager.

                  No i am a married an have 3 kids how do i stand with the contents of my house,My children inherited from there granparents when they passed away or my husbands as it was items from his parents house i litrally own nothing apart from my clothes. Thanks xx

                    no i moved in september when my dad passed away as i was a emotional wreck. I just cant think straight at the moment im worried that the bailiffs will come when im out and my sons come face to face with these peolple.

                      If they did anything while you were not there, they would lose their jobs! Don't worry - if Ploddertom is on the case, you're in safe hands. BB seems to be chasing up the certification bit, though may be quicker to phone them, then the relevant court tomorrow?

                        I feel that your best course of action, Nickola, is to speak directly to the Area HMCTS Enforcement Manager first thing tomorrow morning. HMCTS does not take kindly to the sort of behaviour Marston Group is currently engaged in. In view of Marston Group's non co-operation, I think it unlikely they will volunteer the bailiff's details. The other problem is that there have been cases of bailiffs tending false particulars, seemingly, to avoid a Form 4 complaint for conduct they know, themselves, the law does not permit.

                          SERIOUSLY DODGY BAILIFF ALERT


                          I have today received an email from HMCTS Certificated Bailiff Register at Northampton CCBC regarding the bailiff referred to in this thread.

                          THEY CONFIRM THAT THERE IS NO BAILIFF REGISTERED UNDER THE SURNAME MENTIONED WORKING FOR MARSTON GROUP.


                          Either the bailiff has given a false name or Marston Group have allowed a person who is not a certificated bailiff to enforce court fines, which is in breach of their contract with HMCTS and the law.

                          The OP may wish to consider making a formal complaint to HMCTS and the police.

                            hey guys, I have also had the pleasure of dealing with mr.carlton from marstons. It wasnt for myself it was on behalf of my partner that didnt pay a drunk and disorderly fine. he said the total was 420 to be paid immediately or he would be round to force entry with locksmiths etc. he was very agressive and intimidating, and he shouldnt of even been speaking to me about my partners case! i have paid the bill now as i couldnt be bothered to deal with him anymore and different websites were saying i had rights to different things. i have read in this thread that he is not even registered??? how did you find out this? who do i contact to find this out myself as i am desperate to know so i can call the police.i already contacted them yesterday regarding his conduct and threatening behaviour, i would really like to take this sucker down.

                              I fear you will find the police say it is a civil issue. If you look in the 'Stickies' at the start of the bailiff tab at the top of the page, look in the Council Tax one and you'll find the information about confirming certification.
