I have to agree with Ploddertom that HMCTS has been somewhat premature in involving Marstons.

Yes BB i think the key here "until we see"

I must echo Labmans concerns about advice being given via PM. none of us are experts here, our strength lies in our communal knowledge and experiences, and also our ability to correct each others errors, cant do that if the conversation is going on via PM.

FWIW, I've had several pm's in the past week or two asking for help with bailiff issues. Every single one has been asked to post on open forum. One recently where I did respond to the pm, I immediately posted what I had done on the thread so it was all above board.

To me, it gives the OP a wider audience, rather than putting all responsibility on one person, and also protects you and the OP from any incorrect advice given - we all make mistakes.

The only reservation I would have is where a bailiff or bailiff company has done something seriously wrong, possibly, criminally-wrong, and to post it on an open forum could warn those involved and enable them to escape justice or being held to account for their wrongdoings. Other than that, I am in agreement with keeping things on an open forum.

I agree with you here, but I think it's important then to let a member of the site team know what you're doing and ensure a copy of everything is sent to them.

            Re: Marstons Baliffs

With regard to the bailiff named on this thread, subject to confirmation by Altrincham County Court, HMCTS Certificated Bailiff Register at Northampton CCBC has advised today that his certificate expired 8 December 2009. I will contact Altrincham County Court on Monday and post the result on this thread.

              Incompetence or brown envelope?

If it expired that long ago then it should have been renewed twice - Dec 2009 & Dec 2011 - if it is still expired then Marstons also have some explaining to do.

HMCTS confirmed, by email, yesterday, that the bailiff has not renewed his certificate. However, as stated, I shall be contacting Altrincham County Court on Monday to confirm whether the bailiff has renewed his certificate. This bailiff is not the only Marston bailiff operating without a certificate.

UPDATE: Telephoned Altrincham County Court this morning. Left message on their answering machine and awaiting confirmation about the bailiff's status, i.e. certificated or uncertificated.

FURTHER UPDATE: Have just spoken to Altrincham County Court Enforcement Section. They have confirmed that the bailiff referred to in this thread has a valid certificate that was issued on 7 December 2011 and expires on 6 December 2013. It appears the Central Register hasn't caught up yet since moving from MoJ HQ, in London, to Northampton CCBC.
