    Thanks guys for all your input, I've texted my BIL to phone me whilst on his way to pick up the car, I'll give him a list of questions to ask when he gets there and report back when I have some answers.
    This could get interesting lol.

      Reading the attached I am concerned about two points: a) DPA as mentioned above: b) authorisation for removal of private property from the PRIVATE PROPERTY, as I am assuming that Bluewater car park belongs to the shopping centre. If Bluewater claims no knowledge of the removal what there to stop me turning up with a truck and start "removing" loads of lovely cars for "infringements"?

        There was a case similar to this on CAG a few months ago where JBW towed a car parked on a public highway with the driver nearby. To the best of my knowledge and belief, the LA involved had to return the vehicle and refund all charges levied by JBW. There was an irregularity relating to the warrant that caused considerable debate.

        In my considered judgement, a lot of certificated bailiff companies chasing unpaid PCNs either sail very close to the wind legally or openly and blatantly break the law. Due to the fact that police officers receive little or no training in bailiff law, they continue unchecked.

        I hate to say this, but people are a lot more savvy about their rights and what the police and the likes of certificated bailiffs can and cannot do. It is only going to be a matter of time before certificated bailiffs, behaving like idiots, get surrounded by peeps and told to go away whilst they can still walk.

          Personally ,,if I was Sapphy,,I would request,,nay DEMAND,full compensation for not being able to fit a decent flit round the shops !!

            Well he's picked it up, it cost him £1062.20p for the priviledge. He asked how the car got to the car pound in Roydon (that's where they kept it) apparently it was lifted and put on a low loader, he did a complete check of the bodywork and all is fine.
            He's spoken to Harrow Council and they have emailed him a form called a Statutory out of Time Declaration (think its that anyways), he has to take it to a solicitor, get it filled out and swear on oath that he never got the letters or visits from the Bailiffs, then it goes in front of an appeals tribunal whatever they call it and hopefully he MAY get some money back.
