  • Marston bailiff for TV licensing

    We had missed direct debits for the TV licensing and had received a letter from them about this. Then out the blue we had a visit from a Marston bailiff just two days ago. He claimed he had visited the week before leaving a red bordered sheet with the amount shown but we hadn't seen this and that we had should have had a court letter from Marston on black and white letterhead (not the red border). We received no letter.

    The amount he wanted was £775. He claimed he had a warrant to allow his entry to take goods and is insisting on this being paid within the next day.

    Having read some threads about Marston he appears unlikely he has a lawful warrant unlike a signed and sealed court order allowing entry. Also, I have no idea how they arrive at the amount they are insisting upon. When first arrived at 6.00am on Thursday he said the original amount was £475 but that his 2 visits of £150 each had increased this to £775. When speaking on the phone to him to try and get some sense of the situation, I insisted I hadnt seen the first red bordered sheet from his supposed first visit. He then changed his story to say he hadn't charged for one visit and that his visit charge was £215 plus £85 (this sounds familiar from other threads).

    My beef however, is that I dont feel I have had warning of this amount. I have seen no court letter from Marston for the original £475 sum. If I had likely I would have rung and agreed some payment with them.

    To stop further action I would need their agreement were I to make a lump sum offer but I refute their method of adding to the charge without any discussion.

    Where do I stand on this? Any help would be greatly appreciated.

    Again reading the helpful threads elsewhere he sounds like a certified bailiff.

    Also, how set in stone are their time frames for payment?

    Do I need to agree them? Apparently not. After all, wouldn't we all be delaying as long as possible, but how enforcible are their time frames by law?

      Have you been summonsed to court at any time for non-payment of your TV license?

        Thanks for the response, although Marstons say that we received a letter, we havent seen it, I want to contact them to attain a copy.

          Have you received a summons, or a Further Steps Notice? If you have not received a summons, you need to contact the magistrates court that allegedly issued the summons and ask them why you did not receive a summons. It is likely you will need to swear a statutory declaration. If you did receive a summons and the amount of fine, the court is required, by law, to send you a notice called a Further Steps Notice before instructing bailiffs. It sounds like proper procedures have not been followed. I would be inclined to start asking searching questions about the alleged summons, etc..

          As for the Moron from Marstons, he cannot enter your home without your agreement and, in any case, he needs written authorisation from a court in order to force entry. He seems a tad confused about his fees as well. By the sound of it, he is full of the brown and smelly stuff.

          Do a bit of digging and you will probably find proper procedures have not been followed.

            Please remember this is a court fine for a 'criminal offence'...if you have not received the summons to attend court and have been fined in your absence, following which you should have received a Further Steps Notice, then you need to go to the issuing Court and ask to make a Statutory Declaration to that effect. Had you by any chance moved house between the time the offence was committed and the issuing of the summons?
