      Re: advice needed please....

I'll be interested in the opinion of others more learned than me here, but they appear to have done everything by the book.

The bit I question is the fact they posted attendance through your letterbox, and that letter had no details on it. Did it have the name of the bailiff who attended, the time and date? You should have had chance to ask to see the warrant etc... though clearly you can't do that if you're not there.

Assuming they did attend and left the requisite details on the card, I think you have to pay up. I would imagine a letter to the Fines Manager pleading the fact you have paid the fine. Unfortunately they do not mess about in passing the fines over to their enforcement agents.

          Re: advice needed please....

Check the name of the bailiff (see link from Bailiff Guide). They can't apply any more fees now and are almost certain not to be granted a warrant to force entry, so keep the bailiffs at arms length and take time sorting this to see if we can avoid the extra fees somehow, though they do seem to have done it right to me. There's plenty on here more knowledgeable though!

Speak to the local HMCTS Enforcement Manager. Ring the court and ask for their direct telephone number. If Marstons are playing silly beggars at all, they of all people should be able to nip it in the bud.

                    Re: advice needed please

If you have any doubts as to a bailiffs bona fides, send an email enquiry to cbregister@hmcts.gsi.gov.uk and insert the words BAILIFF ENQUIRY in the subject box of your email browser. If the bailiff in your case has not informed his certificating court of a change of employer, his certificate is, in all probability, invalid and he cannot levy distress. In short, he has no power or authority whatsoever.

                      Re: advice needed please

Is the bailiff acting on behalf of a bailiff company? If its his own company, then his employer should be his own trading name or registered company name as the employer as far as am aware.

If it is blank then he is self employed but I would suggest you contact the Court to find the current status. If still as self employed then you should contact HMCTS and ask if they allow their contractor - Marstons - to sub contract.

Tinkerbell - suggest you edit out his name! He could be a private bailiff.

Think this & http://www.legalbeagles.info/forums/...-needed-please should be merged, as they are both dealing with the same matter.
