    Re: Commercial Property Distress Baliff

    Hi Stu,

If the police are now involved in your case, I would hold fire on engaging a solicitor without first checking with the police. Mr I C Russell is showing on the MoJ Certificated Bailiff Register as working for K & I Enforcement Ltd of Nottingham. If he is now working for Direct Bailiff Services Ltd and has not informed his certificating court, his bailiff certificate is invalid, which means he cannot execute distress. You need to pass this information on to the police immediately, if not sooner. I can see the police sending Mr Russell an invitation he cannot refuse.

This gets better by the hour hopefully the police will act and the guilty punished time for a change in the way bailiffs operate

Yes, ive got some updates, but got to shoot now, will update you all later. Bailiff - I C Russell wont now communicate with me, he puts all liability onto Direct Bailiff Services Ltd, which is a firm who dont employ any bailiffs directly.

          It just seems dodgy..dodgy...dodgy...

Police are chomping at the bit to get stuck in which surprises me!!! But Ive asked them to hold on, until I see a solicitor, I need to know the point of law, and if what they have done is unlawful. Ive found a cracking firm in Derby, they are right up for it, and they charge £180 per hour, which is cheap. I'm meeting them 4pm tomorrow. I will put a £1000 k on account and get some letters sent

Let the police loose on them, as they are only wanting to get involved because they see that a serious crime has been committed such as fraud. You can still seek advice from the solicitor independently to that of the police criminal investigation.

I bet your land lord may have bought a fresh pair of brown underpants to disguise any stains and the lack of bowel control that he may be suffering from now lol.

Absolutey Teaboy, you are spot on... go for Sharker the police want to do it, do not stop them.

Continue with your Solicitor as well as you may have to take action against the landlord/bailiff for unlawful taking of your money as you need to get this back from them as well. The police will not do that for you.

              Good luck

One thing that you could do is ask the police if they wish to liaise with the solicitor you are going to see. This can be of assistance to them, especially if it clarifies a point of law or area of the law with which they are not familiar or provides them with a thread of enquiry that might not be obvious at first. I would post a few packets of Imodium Plus through your landlords letterbox and send some complimentary packets to Mr Russell. It sounds like he's going to be in need of them. Oh and don't forget to send a packet or two to the owner of Direct Bailiff Services Ltd.
