I'm going to draft you a letter to send to the Court Manager. make sure you send copies of ALL correspondence between yourself and Marstons, ESPECIALLY the letters where they are alleging you are avoiding paying the fine. HMCTS needs to be put on notice that they are 100% vicariously-liable for the actions of Marstons, including any damage caused to your property and injury caused to you.

yeah i sent the letter the other day, didnt bother phoning again, as when got the first letter from them rang up straight away then when the bailiff came the other day he didnt have no record of phone call or was bothered as the matter is to be resolved now with full payment, now they will have record as sent it recorded delivery

and seems they didnt comeback with the locksmith as went back to flat yesterday and no forced entryAAA:tinysmile_grin_t:

now im just thinking what there next coarse of action will be

even the chap who lives below me aid the bailiff came bashing on his door asking which car I drove he told him to do one then bailiff started to imply he was lying

thankyou very much for the letter, very much appreciated

Hello, i rang up consumer helpline they transferred me to a solicitor who specialises in this, and after a long chat said cant do nothing and have to sit it out for next 3-4 months

they also said bailiffs also treat this like a business so they are not going to invest money to get a locksmith and police to break into my flat unless they are 100% certain have 2k worth of goods in there. She said they try these shock tactics because on a time limit before the fine goes back to court, when it does and if they refuse payment i will be letting the magistrate know and making them aware of what hell ive been through with this bailiff

its just a ****take cant get it resolved in a civil way

Could you PM me the necessary details and I'll draft a letter for you. HMCTS need to be made aware of what Marstons are up to and of their 100% vicarious liability for Marstons' actions. I am building up a file on Marston and the actions of its bailiffs.

my friend suggested buying a cctv system from ebay as there dirt cheap 40/100quid for wireless with a recording device and recording the bailiffs actions then when go back to court showing it to the magistrate as its them whom condone this type of behaviour im sure there well aware of how the bailiffs act

Click on "Settings" at the top of the page. This will take you to another page. Click on "Send Message". This will throw up a box, similar to those on a thread. Type your message, then click on "Post". I will then get a box come up on my browser and an email alert.

UPDATE, sent letter to marstons saying i want to pay no reply then sent another one week later explaining i have witness statements from neighbours stating how violent the bailiff was acting and again explaining my intention to pay, still no response after 1 week, then rang them and was told they dont want to deal wit the matter anymore and its gone back to court so now will just have to wait for court or do u think i should contact them myself?

as i do want to start payin off the fine

                  thanks
