        Hi mlc, I have sent you the trust format, all you have to do is fill it in sign etc, date it as you wish. Just tell the bailiff that all your property is in a trust nothing else, there are several other ways of getting rid of the bailiff also but most importantly do not communicate with them at all

          I forgot to ask everyone....... Can the council pull of the bailiffs permantley if they wanted to and reverse the original fine back to the beginning so i pay the start amount of £55 without it going to court or has it gone to far now?????

            Basically, if there is any legal irregularity in the way the local authority have acted, at any stage, there are legal procedures that can be used to deal with this. If it is found that the local authority were wrong to have instructed bailiffs, they would have to pull them off as this raises questions as to whether the local authority had a right in law to instruct them in the first place.

              so as im disputing the fact i never received the original fine could they pull the bailiffs off and re start the process of sending the fine back out to me, pref by recorded delivery! if on wednesday the lady thats looking into it again for me won't help then im going to have to quit my job and find someone else to care for my mum because im just petrified of these bailiffs and i might aswell give them the car, can't deal with banging on the door and i know it will frighten my daughter and i have to take that into consideration :-(

                Sorry legalese, but this will 100% not work, you cannot open a trust fund and hide your goods from the bailiff, it just doesn't work that way i am afraid.

                Anyone filling in one of these "FORMS" please ensure that you personally know all the parties involved and for gods sake do not send any personal information to anyone from this or from any other consumer forum.

                I tried being subtle, didn't work.

                  Explain further please Davyb as it would be interesting to know why wont it work in your own words, and the members would know the parties as its family. mlc do not be afraid of the bailiff as you said yourself you will give the car to him, FEAR it works then doesnt it DO NOT FEAR.

                  No one has asked for personal details why are you making members fear some sort of deception is going on?

                    No you do not understand, you are forwarding this,it is for you to give foundation for your claims.
                    legal authority, precedent, examples where this has worked.

                    I fully understand the process of constructing a trust, as is fully understand that it will not function the way you say, but i do not have to prove anything , it is not I who is making the claim.

                    We are dealing with a vulnerable person here.

MLC do not use the document then but please use the notice I sent you. These methods work I don't expect you to have any trust in me as we are on a forum, but please use any one of them methods and don't be afraid as this is their foundation to make you pay, beyond your fear they have nothing.

                      Precedents? Well how about your bank that charges you £30 if you go overdrawn, what if the banks take money from your account by mistake i.e you ask the bank to stop a DD but you find out they paid it, you can charge them £30 as they have set a precedent. Its difficult unless you are aware of this precedent which is harder to prove than a criminal precedent which is would be found in a criminal case.

                        I am afraid i cannot comment on the notice because we have not seen it, that is the point, I can however vouch for bluebottles advice.

                        I would not want the OP to waste time waving an ineffectual piece of paper about when their are established methods for dealing with this situation.

                          Another example of fear is this... if you drive along a road without wearing your seatbelt you will eventually be stopped by a police officer, he will ask you why you were not wearing your belt and will give you a fine (i think its £30) if you tell the officer you do not want this fine and that you do not accept it he will arrest you. Now at the station you still do not accept the fine and you sign nothing they will place you in a cell for say 6 hourse, after this 6 hours you still do not accept the fine and sign nothing. The police now let you go with no fine. It is administrative law not criminal law, our country is policed by consent, criminal law is a different matter as you have an injured party. Administrative law, use it.

                            Yes, administrative methods and if you do not fight back then you pay, ignorance of the law is no excuse, if you do not know your rights then you have none.
