        lets hope when she receives the letter from the council in the morning its good news

          just spoken to the lady

          the council have recalled the liability order from bristow and sutor and are going to start taking payments direct from her benefit at £2.00 per week

          its all because of the
          VULNRABLE PERSONS category as to regulations set by the Ministry of Justice. The regulations are contained within The National Standards for Enforcement Agents (Department for ConstitutionalAffairs)

                  i have seen the letter from the council tax enforcement department.
                  they stated their agents bristow and sutor follow all guidlines with vulnerable people and will allways work out a sensable repayment option

                  what crap

                  she got a letter through the door charging her 18 quid and a repayment proposal of £83 a week, she never set eyes on the baliff

                  so much for following guidelines

                      Report Bristow & Sutor to the OFT Credit Fitness Team. They hold a Category F Debt Collection Licence and, as such, are subject to OFT Debt Collection Guidelines as a condition of licence. Setting up a repayment plan the debtor cannot afford is a breach of guidelines and licence. Non-compliance with MoJ Regulations may also amount to a breach of OFT Licence.

                      Their company name is BRISTOW & SUTOR CIVIL ENFORCEMENT LIMITED and their Credit Licence No. is 155278.

                        how can a baliff company also hold a consumer credit licence for debt collecting, i can see it now, i am mr xyx from bristow and sutor and i am a baliff. i need to talk to you about your debt with crappyquest

                        this must be a conflict of interest giving the impression you are a baliff for collection of consumer debt that has never been near a court

                          It is usually a condition of contract/tender for civil enforcement companies to hold an OFT Debt Collection Licence if tendering for enforcement of public debt, e.g. CT, PCNs, court fines. Additionally, quite a few civil enforcement companies collect consumer debt, as well as public debt, and are required to hold an OFT Licence to collect that.

                          The fact that bailiff companies hold OFT Licences is advantageous to peeps on LB because the more complaints of non-compliance with OFT Licence and rules received by OFT means greater likelihood of bailiff companies suffering cancellation of licence, loss of public debt enforcement contracts, inability to collect consumer debt and potential closure of business.

                            I'm not sure what a Consumer Credit Licence covers, but collection of debt seems a reasonable assumption. I'm all for bailiff's needing to hold such a licence. Thuggery and menace - and perhaps breaking and entering - seem to require further licensing. This will be granted soon - if we are not vigilant, methinks.

                              Well, Bill, OFT Credit Fitness Team are not happy bunnies with The Muppets from Marstons over their forcing their way into peeps homes and assaulting peeps. In fact, OFT Credit Fitness Team are very unhappy bunnies and have already contacted an LB member twice over a complaint they made. It is being taken very seriously. If the OFT decide to issue an Adverse Determination against The Muppets from Marstons and an appeal to the First-Tier Tribunal is rejected, it may well be Adios Amigos for Marstons, not that any of us will lose any sleep over the b:censored:ds being closed down.

                                That's encouraging news, BB. I guess the next stage will be to try and ensure that these scammers can't re-surface 10 yards downstream, as they seem so able to do at present. Not so easy...
