  • bristow and sutor and council tax

    it seems a lady i used to date has got problems with her council tax.
    the council have set their dogs bristow and sutor on her after obtaning a liability order.

    now she is on benefits and receives £141.00 every 2 weeks

    bristow and sutor have pushed a note through her door (first visit) as no answer with a payment proposal of £83.00 PER WEEK for 10 weeks

    as i understand it she will be classed as a vunrable person being on benefits as to

    http://www.dca.gov.uk/enforcement/agents02.htm#part10

    Those who might be considered vulnerable include the following:
    the elderly;
    people with a disability;
    the seriously ill;

    the recently bereaved;
    single parent families;
    pregnant women;
    unemployed people; and,
    those who have obvious difficulty in understanding, speaking or reading English.

    The debt has to go back to either the court (if it was a fine) or the council. These Standards are there to ensure vulnerable people do not have the added stress of baliffs visiting.

    do we have any thread on this in getting a council tax debt recalled from the baliffs back to the council

    She may well be classed as vulnerable but do the Council & Bailiffs actually know this. She will need to write to both claiming vulnerability & enclosing proof of same.

        They will no doubt come back but probably just to poke another letter through the door so they can claim for another visit. Don't forget there is no law that says you have to deal with or speak to a Bailiff. If he does knock ignore him and he'll go away. Doesn't matter how many times he comes as long as he doesn't gain entry or levy on goods outside he can charge no more than for 2 Visits. The chances are that once he finds out she is claiming vulnerability he will see his fees disappear so may give up anyway. Any letter sent should be sent initially by email followed by one in the post.

            I've only just posted this in Royalie's thread, militant. It's the best I could come up with.
            They seem to be very coy with their email address, don't they, Royalie ? The only email address I found was their personnel dept, careers@bristowsutor.co.uk - so, if you want to be a bailiff, they'll chat with you - but if you have a debt query, they won't !!!

            If you have a contact name, then you could try emailing " contactname@bristowsutor.co.uk " or " cname@bristowsutor.co.uk "

            Nowt to lose.

                            The droppings we leave in our wake seem to have value to future generations, don't they ?
