    hi i wonder if u kind people could help, i had a tv fine from court that was £110 all together, i went on hols and my direct debit didnt get set up proply, i then on hol got a slipped disc, and as soon as i got home i was in hospital, in agony, then a week later had an mri scan that revieled i needed an op, im now off work on ssp my hubby is out of work due to 2 hernias his op is next month, i had a letter saying my debt has been tranferred to tne bailliffs, i called the bailliffs to say what had gone on and he told me he would call head office to see what they could do, (very kind i thought) in not hearing in 3 days i got a sheet of paper through my door to say i now owe £370, my debt was £110, i owed £70, then it went to £185 as it had been passed to them, now its £370, i called thebailliff to say i had been waiting on his call and he said i gave him the wrong number???? i also asked if he spoke to head office and he said no as he didn have the info infront of him at the time???? (bare faced lie) i told him i was going to speek with debt advisor and he said do what you like as he not playing piggy in the middle, the lady spoke with him on the phone to ask him few questions and he just told her he was going to break in anyway, she asked for his no and name and when she told him she was from welfare rights he said oh i was messing, i didnt men it, ??? sonow i got him coming round tomorrow, he said he wants to take my stuff and is adiment that they do not do installments, i have been told to let him in and to see i have nothing in the way of goods that are good enough for the ammount he wants, but im worried that he is just going to take anything to make this ammount up? what do i do. thanks a worried mum xxxx

    i have also been told to call his bluff and what ever he writes down, within reason, then just tell him to take it, as im not sure if when he comes tomorrow he is going to want to set up payment arrangements, and if so how much per week, is it worth saying take it, the dryer in my house is my sisters as she moved and there is one already in her house, but she said i can use hers untill she needs it back, can he take it? i can not afford to have gas on so its my only means of drying when it rains.

      Dont let him in.
      Keep your doors and windows locked he CANNOT break in, if you have a car, move it out of the road so he cannot levy it. call the courts and explain the situation and ask them for a stay of execution due to ill health, also ask can you arrange a payment plan with them directly.

      In the meantime, you need to write to the baillifs asking for a breakdown in charges.

      If the baillif arrives, do NOT argue with him, tell him to post the levy through the letter box and come away from the door.If he starts threatening to break in etc, call the police and ask for help as you are in poor health, and the baillif is aware.
      He cannot break in, he cannot have your children taken away from you, 99.9% of the things he will threaten you with, legally he cant do it. If you have a video camera, it may be worth videoing his actions.

        i have been told by the debt advisor from the council that i have to let him in as its a distress warrent from the court, legally he can get in my house with locksmiths etc.. i told him that the debt advisor is writing to him and the courts with a money expenditure but he is not interested,, i also phoned the court and they said nothing they can do as i missed my payments, i explained what happened and they are not interested and just told me to call the bailliffs supervisor???

          im gona shout out for more help here hun.. im pretty sure there is an office you can deal with in the court as you missed the payments due to ill health.

                  they have just said that nothing they can do its up to the bailliffs, they said show him my medical cert to say off work and why and then he may send it back, she said he can come in tomorrow and write down goods to take and then come for them 24hour later? im just so stuck x said i can not go to court about means tested as its with baillifs and thats that basicly x

                      The debt advisor at the council should be sacked. What they have said is totally incorrect. Did the OP receive a Further Steps Notice? If HMCTS has been side-stepping the proper procedures, any distress and/or levy will be irregular, if not, illegal. HMCTS know damned well they are 100% vicariously-liable for the actions of The Muppets from Marstons. A certificated bailiff cannot break in without a signed and sealed court order and the police in attendance. Also, no locksmith, especially those who are members of the Master Locksmiths Association (MLA), will assist anyone to gain forcible entry to property without sighting a valid court order and the police will take the same stance. No lawful authority, no entry. Do not let the scumbags, sorry, bailiff in, no matter what threats they make. Take the advice of videoing everything these thugs do and say. You'll have them bleating you can't film them, but the truth is, yes, you can.

                            Do not give the ba:censored:rd bailiff your medical certificate and certainly do not open the door to the bugger! Get a photocopy of the certificate and pass him that, through your letterbox.

                            Keep your doors and windows securely locked - and that includes the upstairs windows, too, as they are allowed to use a ladder to climb through an open window.
