I need some advice please! I am a disabled person and I have a motability vehicle. I recieved a car parking fine in the post last year and I disputed it with the council. However I didn't receive anything back from them. I did later get an enforcement letter but due to ill health etc. I didn't do anything else with it. I have not heard a single thing from anyone else for months & months until I then had a bailiff from Newlyn standing on my doorstep. He acknowledged that the car was motability and so wouldn't be touched. I have been in contact with the council who are being very obstructive and have so far failed to provide any kind of evidence of an offence, we have had emails going back and forwards but they are very slow to reply. The bailiff turned up again this morning and said that I have 24 hours to pay £487.84 otherwise they will be coming back tomorrow morning to remove goods. I feel sick to my stomach, my husband is ill at the moment, he had an operation on Tuesday and we have about £3 in our bank account. Until husband gets paid in 2 weeks time we are relying on the child benefit. We have about £1700 mortgage arrears. I have asked if it can be paid in instalments although I don't really want to as I don't believe there was an offence but was told no, tomorrow morning the whole balance or removal of goods from within the house. Is there anything I can do to delay this happening? Thank you.

Thank you, so do I have this right as my Fibromyalgia often leaves me a bit muddled. I have to complete form PE2, and the reason is: that I made representations about the pcn to the local authority within 28 days from the service of the notice but I did not receive a reply.
Do I also have to complete PE3, and do I have to take these somewhere to witness my signature?

Thank you both, I will ring the TEC to check. My only concern is Newlyn coming back tomorrow morning, but I know that they can not touch the car, and am I right in saying that as long as I don't open the door or anything to them they can not gain access into the house?

He has no right of entry so as long as you deny him entry he will be powerless. Beware of the foot in the door trick though, although totally illegal he will claim it as peaceful entry and as they are only 2 of you it comes down to the old he said she said scenario. If he does call better to speak to him through the letterbox or an upstairs window and if possible record the conversation.

I am a fellow Fibromyalgia patient like yourself and know exactly what you mean about it leaving you a bit muddled. In my experience, the Northampton TEC should be able to tell you which forms you need to complete and submit. You can download most of the forms from the Ministry of Justice website at www.justice.gov.uk. Click on the link marked "FORM" and enter the Form Number, e.g. PE2, into the box and click GO. It will then take you to the requisite page where you can download the form(s). Go back to the Form Search facility on the Home Page as many times as you need to.

Andrea, I am sure you ring Northampton who advise on the forms. There are two different lots depending which set of Traffic Regulations you were fined under. The number is in my post to PT above, or can be found in the link on my earlier post to you.
The thread explains the process which follows, the first step of which is to send the forms to the TEC.
