  • Rossendales!!!!

    Hi I am a single parent and a student at university not currently working. I have today had a bailiff at the door saying he wants £775.53 in 24 hours or he is taking my car from outside my house! I refused to let him in or sign anything. This is for council tax plus aload of costs they have added. I don't currently pay council tax as I am a student. I don't know what to do I do not have this kind of money and am really worried hes gonna take my car.
    Can anyone give me some advice.

    Hi Kelly2012. Do you have any CT bills from the council for the amount the bailiff says you owe? Have you got a copy of a summons for non-payment? Have you been sent a liability order from the council? IanM

      Were you a student at the time this council tax debt was incurred or was it prior to becoming a student?

        Is your car on HP, lease or contract and if so, how much is it worth and how much is still on finance. Because a bailiff cannot take it away if it is on finance without the permission of the lender and that is rarely if ever given...so providing that IT IS ON FINANCE, if the bailiffs laid hands on it phone the police and report a theft in progress. Take photographs of them and their vehicle before police arrive...you might need them for later proof.

        Do not let them enter your home.

          Hi, no my car isn't on hire purchase it is prob only worth £400 as its a T reg focus. I wasn't a student then but it says Magistrates liability order from 1/2/2011 and I was on Income support then so didn't pay council tax?? It says the amount owed to them in 535.53 then they have added costs by looks of it and want 775.53!

            Only problem is that they gob off at the police officers and then lie through their teeth. However, I do like your suggestion of the OP reporting a theft in progress. That would give them something to gob off about as they were asked to explain what they were doing in possession of a vehicle they had no authority to have in their possession.

            Get in touch with the local authority (LA) and ask them to explain what is going on. If you are not liable, then the LA MUST stop the bailiffs from proceeding any further. If you are not liable and the bailiffs plough on regardless, that's when the Criminal Law kicks in and the bailiffs - and LA - get a kicking in the legal sense.

              It has been suggested by a friend that she will swap cars with me so mine isn't outside and I should transfer the log book into my dads name, if I do this then bring the car back once its in his name can they take it?

                  The Bailiff should have left you a Notice of Seizure, this should list the goods he has seized, is your vehicle described correctly on this? On the reverse of the Notice he should have listed the charges he has applied, can you list them?

                      You need to speak to someone at the Council and ask the following questions:
                      1 - how many Liability Orders they have against you
                      2 - the dates they were obtained
                      3 - the addresses they were for
                      4 - the period of time each covers
                      5 - how much each one was for
                      6 - how much is still outstanding
                      7 - the dates they were passed on for enforcement
                      8 - the dates & amounts of any payments

                          He hasn't left one of these just a notice of distress notice with an inventory which has my car reg under it. He hasn't took my car yet he said he will give me til wednesday to find money or he will come back.
