    Hi All
    I wander if anyone can help
    I am about to start trading. i had a visit from a man from Marston’s and he said he was here from Manchester city council to collect on the business rates which had not been paid. i told him that the company had closed down last year and all the stuff here was mine. And he should go to the registered address of the company. he said that he would not leave. he said that the stuff which is here he believes still belongs to the company which is no more so he can take all of the stuff in the premises and sell it to make up the total. and he would charge£100 per hour if this is not sorted and would not leave. i contacted to old MD of the company now no longer trading and she said she would not do anything and tell him to go and contact the company whose name the court order in. the man from Marston’s then called a friend who came and demanded £2000 not take my stuff. The problem is that all me stuff is with my accountant all I have is the registration of my company. He said if I don’t pay them £2000 then they will take my stuff and I would have to go Manchester council and take proof that it is my stuff and I would still be charged around 3 to 4 thousand pound to get it back. All so I would have to take the MD of the old company with me to in order to get my stuff back.
    I paid the £2000 and they left with money.what can I do…

    Did he give you a receipt for the money? Did he give you a Notice of Seizure? Did he give you a breakdown of the fees charged? What was the original sum owing? Was the now defunct Co a Ltd one? Are you trading or going to trade a similar business to the defunct one?

      yes he did but the amount does not tally with hand witten form. no he did not give ne a notice of seizure,he later gave me a breakdown but it is not signed by me the amout owed is £1463.00 the company is defunct and was a Ltd. the compay sold just beds but i sell everthing. ie furniture and beds.

          Send Letter 1 at http://www.legalbeagles.info/forums/...Useful-Letters to the Bailiffs, send initially by email followed by a copy in the post. Until such time we have some sums to look at it may be awkward trying to comment. You need to speak to someone at the Council and ask the following questions:
          1 - how many Liability Orders they have against you
          2 - the dates they were obtained
          3 - the addresses they were for
          4 - the period of time each covers
          5 - how much each one was for
          6 - how much is still outstanding
          7 - the dates they were passed on for enforcement
          8 - the dates & amounts of any payments

          I'm hoping the Council may refuse to speak to you because of Data Protection if the debt is not yours.

              8 - the dates & amounts of any payments the council would not tell me
              the Council would not give me anything because of Data Protection due to the debt is not in my name.

                Just as I thought. In that case the Council are responsible for the actions of their contractors - in this the Bailiffs. In my view I would get back on to them explain what has now happened and insist on a refund within 7 days or you will commence proceedings in the small claims court for restitution plus damages plus costs & will name both Council & Bailiffs as co-defendants.

                    I'm not great with writing things, ask Labman as he's got a mean way with words. If it were me I'd do it initially by phone and demand to speak to the Head of Revenues & CEO. Don't forget you want repayment in the same manner you paid.
