Marstons Bailiffs - Distress Warrant Charges

Hi,

I am looking for some information on the charges from Marstons and what charges i could incurr going forward.

I have a Magistates Court Fine which is unpaid it has been passed to marstons for collection. I fully accept that i owe this fine, some correspondence from both the court and Marstons has not been received and this has lead to it getting to this stage.

They charged me a compliance fee and an attendeance fee - i beileve these are a one off? I called Marstons today to offer a payment by instalment but this was refused they want the full amount, they did not even want to hear what offer i wished to make. I have neither the financial means or goods to clear the total charges. I am out of the house at work 6 days a week from 7am - 9pm.

I currently have the use of a car but this is owned and registered to my father at his address (150 miles from mine )i am currently allowed to borrow it and i am insured as a named driver on his policy only.

my questions are,

• What fees can i expect to incurr for each vist they may make while i am not at the property?
• Will they be able to take the car or clamp this as it is in the parking bay cleary marked with the number of my property.
• Are there any other fees/charges that will be added? The costs Marston have added are already more than 2 times that of the original fine.

I have read as much as i can on the forum but only have limited access to internet at work and dont want to get caught using it for personal use as i will get into trouble - i should be working but i am worried about this.

I would appreciate any advice that you can give.

Have a read here http://www.marstongroup.co.uk/custom.../our-fees.html I believe they may charge the attendance fee at least another twice.

Any vehicle parked in your bay will be at risk of clamping or removal for the simple reason the Bailiff believes it is yours. Your dad should complete a Statutory Declaration as to ownership and you should keep a copy handy to pass to the Bailiff.

The interesting bit
The charges that Marstons apply are those agreed between them & HMCTS and are not laid down in statute. If you were to ignore him and otherwise prevent him gaining a levy on any goods then eventually it has to be handed back to the Court for further action, this may take some 3 months or more however. There is supposed to be agreement between Marstons & HMCTS that they will allow these fines to be paid off over a period of 6 months, however as the Bailiff does not get paid until the final payment is made will probably explain why they refuse instalments.

PT, I think the Attendance Fee is a one off fee, though you are absolutely right in stating that some fees can be charged three times.
