    Hello all. Received a wrongly dated letter from Rundles Bailiffs today saying they wanted all of my oustanding Council Tax debt with them to be paid now or they will return in 48hrs to strip me bare of goods etc...

    Imagine my surprise to receive a hand delivered letter when I came home demanding full payment increased to £858.28 DATED THE 30TH MAY! YESTERDAYS DATE!!!! Both myself and my wife were in all day yesterday and received post and visitors - NO BAILIFFS ATTENDED ON THIS DATE!!!. This letter I received today was fraudulently posted and misleading.

    I have not refused to pay and have made a payment. The next payment of £100 will be paid on the 1st June 2012.

    This should bring my balance according to your website records down to - £520.28.

    These payments have been made each month, although not in a timely fashion on the same date but within a monthly period. These payments are more than reasonable and cannot be increased in size as I am unable to afford more. I HAVE NOT REFUSED TO PAY NOR AM I REFUSING TO PAY AND HAVE MADE A PAYMENT OF £100 ON THE 31/05/12.

    A quick response would be most appreciated.
    This note has been sent to counciltax@chichester.gov.uk as well as they are vicariously responsible for your companies behaviour.

    Payment was made today and was accepted by your web system and will continue to be paid this way and reduced in size, unless Rundles are refusing to accept payments? In which case I’m sure that Chichester Council will be happy to take back the remaining debt and I will make the same payments to them directly. This is also a formal offer to Chichester District Council.

    Pay the Council direct using their online services...then writ to the Head of Revenues at the Council and tell them due to the distinct lack of reasoning or understanding from their appointed agents you will in future make all payments direct to Chichester Council.

      I agree with you i would also cc the letter to their councillor and the chief exec of the council there is no excuse for bailiffs to act this way i still say everone should pay their CT debts direct to council stuff the thugs

          "Vicarious Liability" is one that should be used. It reminds local authorities they are legally responsible and liable for the antics of their collection muppets. If you have good and strong evidence of Fraud on the part of the bailiffs, you can throw in Section 22, Theft Act 1968 (Handling Stolen Goods). A lot of local authorities don't seem to realise any monies they receive from certificated bailiffs that have been obtained fraudulently are classed as stolen goods. Can you imagine the sudden rush for the ladies and gents toilets at the council offices once they realise that?

            I would like to pay the Council direct on their website, but how would this tally up with the amounts I have already paid out to Rundles? What do I do if the Council refuse to acknowledge the payments in regards to the debt? What do I do if Rundles refuse the same and keep trying to add charges?

                You will need some information from both Council & Bailiffs to sort out where you are. The fact this has happened is solely down to yourself from paying eratically. CT is payable in full on 1 April each year but as a dispensation the Council allow you to pay in instalments - normally over 10 months. If you fail to pay on the correct date they will write to asking you to bring payments up to date, if this then happens again and you fail to pay as instructed then they will tell you that you have lost the chance to pay in instalments and must pay the full balance immediately. Failure to do this will find you ending up with a Liability Order - for which they add the costs to what you owe.

                Councils use the Bailiffs usually as a first course because it costs them nothing and the charges the Bailiff applies pays him. In theory the Bailiff charges should go to the Council but the majority let the Bailiffs keep those fees for themselves. I haven't written this to criticise just to try & show what happens. You may now class yourself suitably chastised.

                You need to speak to someone at the Council and ask the following questions:
                1 - how many Liability Orders they have against you
                2 - the dates they were obtained
                3 - the addresses they were for
                4 - the period of time each covers
                5 - how much each one was for
                6 - how much is still outstanding
                7 - the dates they were passed on for enforcement
                8 - the dates and amounts of any payments

                You also need to ask the Bailiffs for a breakdown of their charges. Use and adapt something similar to this and send initially by email followed by a copy in the post:

                With reference to the above account, Can you please provide me with a breakdown of the charges.

                This includes:
                a - the time & date of any Bailiff action that incurred a Fee.
                b - the reason for the fee.
                c - the name(s) of the Bailiff(s) that attended on each occasion a Fee was charged.
                d - the name(s) of the Court(s) the Bailiff(s) was/were Certificated at.
                e - the date of the Certification.

                This is not a Subject Access Request under the Data Protection Act S7 1998 so does not incur a fee of £10. You are obliged to provide this information.

                I require this information within 14 days.

                Yours faithfully

                  Your case seems very similar to a case I've recently helped another LB member with, but involving Rossendales. It is possible that both yourself and Chichester Council are being defrauded by Rundles, especially as there appears to be clear evidence of phantom visits. Ring Chichester Council first thing tomorrow morning and ask them how much Rundles has handed over to them. Once you have done that, come back onto this thread and we'll help you with the next steps you need to take.

                    There is no law that says you have to deal with or even speak to a Bailiff. Providing you deny him access to your home or otherwise prevent a levy on any goods outside the Bailiff becomes powerless. He may only then charge a total of £42-50 no matter how many times he calls. You may pay the Council direct using online banking, Council website or automated phone, this payment is accepted by the Council and will provide proof of a willingness to pay. If they then decided to take further action it would certainly make life difficult for them. One thing you must be aware of is that with CT he Bailiff is allowed to deduct his fees first so you must budget extra for these. Also note that even if you pay the Council direct the Bailiff may still call to try & force you to pay him, do not phone him or engage in converstaion with him unless you can record the call or conversation as they do appear to suffer badly with memory problems on recall.

                      Your council must accept direct payments - just keep proof (payment ref, etc...) when making phone payment or online payment. This also confuses buggers AND the whole of your payments goes against your liability. But you must do as recommended above as well.

                        Should I stop paying Rundles and pay CDC directly or should I pay both a similar amount. ? And is the money I have already paid to Rundles going to disappear into the Ether?

                          If it were me I would pay the Council then man the fortifications ready to repel boarders. Monies you have already paid have to be accounted for. One of the reasons for applying for a breakdown is that in many cases they try to say their fees are X, Y & Z whereas in reality they are actually A,B & C giving more towards the debt than what they say. Whatever happens has to be your decision, if you can manage the hassle of the threats of the Bailiff then go for it. Nothing will resolve itself overnight and you have to be prepared for the long haul which may last 3 months or more.

                          It will pay to read other threads both here and on other sites to get a flavour for things.

                            sorry to be a pain to all.. but should I inform Rundles that I am now, due to their aggressive tactics, lack of compassion and refusal to speak to me further, that I am now going to be paying the Council directly?

                              Do not pay the Bailiffs anything at all! Do not speak to them and do not open the door to them! Make all your payments direct to the council and only pay the amount that is stated on the LO.

                              It is looking more and more likely that the bailiffs have no legal grounds to collect your outstanding CT if the council have not followed the correct legal process for collecting an account in arrears which is why the council have the account returned to them if you kick up a fuss about the bailiffs.
