  • Help bailiff outside now!!!

    Hi guys i need help urgently marstons bailiff outside has a distress warrant and says he can get a lock smith in today to levy goods today and remove goods today! any advise please

      ive stummped up 300£ to him and he will wait for rest next friday!

        He has gone now the debt is 550 i have just given him 300 and i have to pay the rest next friday. he basically threatened a locksmith and i paniced. The debt is for a TV license fine so im not sure if he does have the power to get a locksmith? is that forced entry?

              Hi mrs james. As i finish work at 4.30 most days my plan was to call them today when i finish at 1. i have had to leave work at 10 as my girlfriend rang me at work so i could deal with him. very embarrasing telling your boss you have to leave work because a bailiff is threatening your girlfriend! I have now spent the money i was due to pay for another council tax debt from another thread and am short for shopping all week. Great eh.

                Please be assured that no reputable locksmith (especially members of the Master Locksmiths Association) and certainly not the police will allow any certificated scumbag, sorry, bailiff to force entry to residential property without first being shown a valid written order signed by a judge. If a bailiff cannot produce such an order, any threat would be a breach of Section 2, Criminal Damage Act 1971 (Threats to Cause Criminal Damage).

                  hi blue bottle the document he gave me was a distress warrant is this different to the written order you described? it has not been hand written or hand signed. i rang the court issuing the fine and they said they have given bailiff permission to force entry.

                      The general rule where certificated bailiffs have authority from a court to force entry to someone's home is that police are present to prevent a Breach of the Peace and ensure the bailiffs stay within the law (There are police officers who don't get taken in by their lies, despite what gets posted up.). A reputable locksmith will also insist on them being present and most will refuse to break locks without police or other law enforcement officers being present. It is for their protection, also.

                      Authority to effect a forced entry will normally be stated on the warrant. If it isn't, query it with the Court Manager. As soon as possible.
