  • Help Bailiff problem

    Ok I have a problem that I hope someone can help me with..

    My ex partner moved out a few months ago and I have had a bailiff knock on the door looking for him to which I told him he no longer lives here..

    They have now sent me a letter stating that because I havent replied to there previous letter (which I never got) with proof of occupancy they are now going to proceed with the execution of thr warrant in there possession by way of seizure of goods at my address!!!! In the next 7 days and the letter was dated the 14th!!!!

    Now nothing in this house belongs to him and he no longer lives here!

    I have only just got round to taking his name off the council tax today after coming home to this letter!

    What do I need as proof of occupancy?

    Also can they take things from my house?

    This is very worrying can someone please help?

    I have never let these scumbags in but can they let themselves in without me being here??

      No, they cannot and won't just come and let themselves in. What they might do if they genuinely believe he lives there still is try to levy on a vehicle outside as these are easy pickings for them.

      Have you any idea what they are chasing him for, or where the bailiffs are from? Do not let them in, no matter what, but tell them he does not live there and everything in the property is your own. Try to find out what the bailiffs are after your ex for, and write to the court and the LA explaining the situation and ask them to call off their enforcement agents.

      If this achieves nothing, you may need to do a Statutory Declaration swearing an oath stating he is no longer there.

        They are after him for a limited company debt that he pg. The bailiffs are called c.n. Gaunt & sons.

        Do you know what I can give them as proof of occupancy?

          Presumably the new Ct bill is purely in your name - that should suffice. Before approaching the bailiffs though, contact the Fines Officer or Court Manager of the issuing court - they might instruct the bailiffs for you, and save you having to deal with the obnoxious wazzocks.

            Gaunts will be acting as High Court Enforcement Officers, you will need to have a Statutory Declaration sworn and send it to them. Here's a sample of what to use, adapt to your own needs. You can take it to any Solicitor - usually no appointment needed - and ask for 2 notarised copies - cost £5/£10 each, some County Courts will do for free. Send 1 copy to Gaunts and keep the other handy for a knock at the door.

            STATUTORY DECLARATION

            I,____________________________ ______________

            address___________________________________________ ______

            __________________________________________________ _____

            make the following declaration under the Statutory Declarations Act 1835:

            All items contained within the property at the above address and within it's boundaries, are owned by Mr XXX XXXX & Mrs XXX XXXX . There are no items within the property or it's boundaries belonging to any other person.

            I understand that a person who intentionally makes a false statement in a statutory declaration is guilty of an offence under section 11 of the Statutory Declarations Act 1835, and I believe that the statements in this declaration are true in every particular.
