  • Negotiating with Marstons bailiffs, lol.

    I would just like to clarify, if Marstons have an aggreement with magistrates court to spread the payment of a fine over 6 mnths? There must be something in place to give people time to pay the bailiff. Although I do understand this is the last resort
    and they have been given chances.

    I am dealing with a baillifs account for a client. He rang to negotiate monthly payments, as he could not afford the one off payment, the baillif did not accept, what a surprise!!! He then turned up on his doorstep the next day and added the attendance fee £215, I know they are ruthless, but things have got to change. Luckily my client is not vulnerable, just scared. I could not access the bailiffs guide, so I do not know if my question is answered in there.

    It would be great if any one knows anything knows anything about negotiating with these people, if you can !!!!!!

    Hi and welcome to Legal Beagles.

    Was a court order in place allowing your client to pay in instalments and is it being complied with? If so, Marstons cannot over-ride it. If a bailiff or bailiff company takes it upon themselves to defy such an order, that could amount to contempt of court, in which case the District Judge at the court involved has the power to call the bailiff and his employers in for a very stern chat. Could you please post up full and better details so that LB members can provide you with the best advice we can?

      The great problem with all these cases that are sent to Marstons. Phillips, etc is when the Bailiff gets paid. In Council Tax they are allowed to deduct their fees first but for these Magistrate Court Fines they only get paid when all is paid therefore explaining why they don't want instalments.
