    hello, a phillips distress warrant came by post to our house yesterday, it was addressed nto my grandson, but he does not live here, my husband opened the letter by mistake, it was for non payment of a fine. the letter says they can break into my house, so now my husband says someone has to stay in at all times. i tried to ring their office but it was closed, and i sent an email but it was returned also the web address page has gone, it says outstanding amount 1,195.00 and everytime they attned the property 215 pounds will be added, i am so worried as i really dont know where grandson lives he has been changing addresses for the last 2 years since his parents split, he is 21 years old. i did suggest to my husband that we ask to start payment plan but he says no as we just have pensions and we have helped him in the past, can anyone help us please.

    Hi and welcome to Legal Beagles.

    First thing Tuesday morning, telephone the court manager at the court that imposed the fine and explain the situation to them that your grandson no longer lives with you and your husband. After you've done that, ring Philips and tell them what has happened and that you have spoken to the court manager. If the house is yours and your grandson no longer lives with you, Philips would be ill-advised to try and break in. Also, a bailiff cannot levy on or seize property that does not belong to a debtor. If Philips still insist on acting like the prize pillocks they are, go back to the court manager and ask them to kick Philips into touch. The very last resort is involving the police, but only after speaking to the court manager and asking them to bring Philips to heel.

        They won't break in, don't worry. The most important thing for you at the moment is to ensure the court and the bailiffs know your grandson is not living with you.

        In terms of helping your grandson, if you have a phone number for him, one of the best things you could do would be to point him towards this site. Burying his head will only increase any fine owed and make the situation worse. If he is able to post up his situation, there is a good chance we would be able to help.
