    Zun Noon, of east London, won damages against Newham Council, apparently for the emotional distress he had been caused by bailiffs.

    Mr Noon was caught by CCTV committing a parking offence in October 2007 and fined £50 by the council. When he failed to pay, bailiffs were called in and the case closed.

    The following month he received two more penalties of £50 and again did not pay. A fourth penalty was dropped when it was pointed out that it duplicated the previous one.

    Mr Noon then pursued his case for damages and when the council failed to appear at a county court hearing, he was given judgment by default and awarded £5,000 for each ticket, making a total of £20,000.

    Officials at Newham Council were given a chance to challenge the award at the High Court, but again failed to show. Bailiffs were then dispatched to council offices in East Ham last November and began ripping out computers. They were about to unplug a crucial file server when the staff gave in and agreed to pay up as ordered by the High Court, according to a spokeswoman for the council.

      Like the story but the postscript is even better:

      "Last month the council, which claims it never received the court summonses, took the case to Bow County Court, which ruled in its favour and ordered Noon to give the money back. His repsonse was that he cannot do so - because he has already spent it."

        Apparently, Newham Council took this back to court & overturned it.

        Reason given - "They didn't receive the summons"!

        Would Joe Public get away with that in a council tax liability order case?

          Does anyone know the actual grounds he went to court for? i mean did he ask for compensation cause of the stress it caused him or some other reason? it might be cause of the bailiff at his doors but would love know the reason.

            I like the image of the bailiffs tuning up at the council and confronting those self rightous B**ds that refer accounts to the courts for enforcement without a second thought.
            Dont suppose it will make a difference but it made me smile.

            I would imagine it would be breach of duty of care, maybe?
            This tort would leave him open to issue a claim for damages.
