Hi,i Really Hope Someone Can Help Me With A Few Quick Questions,as I Badly Need Advice.i Was Paying A Court Fine On A Payment Plan, and Fell Behind Payments By Two Weeks.as A Result, even Though I Continued To Pay,the Court Issued A Warrant Of Distress To Phillips, with Only Two Payments Left On Fine, which Has Been Fully Paid.i Requested That The Warrant Be Canceled, but Was Refused.my Question Is,do Phillips Still Have The Power To Force Entry For Their Bailiff Fees, and Does It Turn Back To A Civil Matter Now The Court Has Been Paid?i Resent Having To Pay Bailiffs Almost As Much As The Court Fine, which I Had No Issue With,i Just Had So Much Bad Luck At The Time,i Forgot To Make Two Payments On Time, but Phillips Don't Deserve A Penny,£115 And All They've Done Is Post Two Letters.please, please, can Someone Tell Me,is It Now Civil Court Matter Or Still Acceptable If They Catch Up And I Want Pay And Own Nothing Of Value.can They Still Force Entry Once Court Has Been Paid.sorry For Long Post, and Thank-you All For Any Help And Your Time.nikki

    Re: Philips

Isn't this exactly the same issue you posted about a few days ago and received answers to?

I've looked up your last post and it looks pretty much the same to me. Apologies if it is different.

Hi Labman, firstly A Big Thank-you For Replying.yes Post Is Pretty Much The Same, except Now Fine Is Confirmed As Paid, but I Still Don't Know If It Now Reverts To A Civil Matter, and I'm Still Unsure As To Phillips Powers When Chasing Up Their Own Fees, not Courts.i Think I gave The Impression That I Hadn't Paid All My Fine, and Still Had An Outstanding Balance, which Is Not So.i Don't Want Them Kicking In My Door Legally For Their Greedy Fee.could You Advise On These Matters?.once Again,thank-you Kindly, regards, nikki

        Hiya,
I'm on my phone so can't easily flick between posts. Can you remind us what the original fine was for please.

I'd be inclined to send the bailiffs the letter asking for a breakdown of their fees. You will find it easily in other bailiff posts, or I'll post it up once I get to my computer.

HI labman, original fine 's 130.00,because police officer did me for defective brake pads,as I build bikes, earning my living on one,and my life depends on decent brakes,it was highly exaggerated, even had my pads in top box on way to change them that mornings, and did so by roadside, infront of police,oh well, but paid all the fine, just some payments were a week late, and it was between that that Philips got involved by court.I really don't WANT TO get intouch with Philips, their not pleasant, and I DON'T think they deserve A penny. I too am on phone, keypad playing up,sorry FOR mistakes.regards,Nikki

So the fine you were given was a Fixed Penalty Notice?

Hi labman, not too sure, there were no points given, but it was given by police,so I guess so.will have TO double check that one.but did ask for more time to pay which IS why payments were made on a payment card from the court, and as I said, some were a week late.many thanks, kindest regard,NIKKI

Hi nikkijr1, your case have got some similarities with my case where i paid the fine and got a letter from marston. Now i am no where near someone like labman who has proper knowledge and knows what he is talking about and i would not say that u should do or take the same kind of route as i did but it might help u understand a bit more if you read my thread as well as it did help me when i kept reading the cases which were similar to mine otherwise u are in good hands

Mohmmad - I'm no guru on bailiffs, so anything that can be added is welcomed. I am the first to admit I've loads to learn about the area, so all contributions welcomed.

Off to have a look at your link now - thanks!

                        Re: Philips

One small thing about the point Happy Contrails makes about the statement on page 5 of the Ex345 booklet is that on page 10 it states:

What is the cost to me?
Each debt type has a different fee-charging regime, which allows the enforcement officer’s charges to be added to your debt. Details of these fees can be obtained from the issuing creditor.

Until I know for sure which of the apparently conflicting statements is true I will not quote this leaflet.

As I have said since the start, I think the court needs to be contacted to get the bailiffs' fees removed. One wonders if these are automatic instructions, and if a human has actually even seen the warrent and how idiotic its issue is.

When you say the fine is now paid, who did you pay the last two payments to? Was it the court or Philips?

The reason I ask is, when I was paying my fine and was two weeks late in paying the last installment (when every other payment had been on time) the court passed it over to Philips. I did pay the last installment to the court, all be it two weeks late, but because the court had passed it to Philips the court sent my payment back and told me to deal with Philips.

I think the court were a tad hasty in passing it to Philips just because I was two weeks late paying the final installment. How much of this is going on? Are the courts assisting Bailiff company's to make money?

Hi Mrs James, after I became aware that court had passed the fine to PHILLIPS,I continued to make two further payments ON payment card, which they confirmed as received, them I made final payment, but as it takes two days to show up ON card I need to make sure final installment reached the COURT,although don't see why not if they chose to TAKE payments after warrant .I HAVE all receipts for each payment made on their card, and haven't been informed of any rejected payments since phone call to them on Monday. Thank-you for your interest, regards,Nikki

You should not 'have become aware' though, you should have received a Further Steps Notice.
