    Needs some advice pls.

    Have been paying this so called company since October 2011 via direct debit, in December my bank cancelled the wrong direct debit (Equitas) by mistake. As soon as i realised i contacted them and agreed to may 2 weeks the following week.

    Then I received 2 letters on the same day via the post (one dated 13th Feb and one dated 14th Feb, i says a bailiff will be calling in the next 24 hours (nobody turned up) and the other saying we may instruct bailiffs to contact you .

    Called them and was told that no one could speak to me had to speak to the bailiff direct, called him and he was happy for me to continue paying weekly etc.

    I asked for a detailed statement to be sent to me

    Debt £271.46
    Statutory Visit Fees £42.50
    Levy £27.00
    Dishonoured Payment Fee £65.28
    Total £406.24

    Payments received £245
    Balance £161.24

    Called Equita to discuss charges and the first to people i spoke to hung up on me, Have spoke to someone this morning and explained that no baillif ever came to my property and was told to "prove it" and was hung up on again.

    Some advice would be appreciated - thank you

    The onus is on them to prove they did visit. I note there is a levy fee mentioned - was this charged on the same date as the 2 Visit Fees? Can you also list the items seized exactly as described on the Notice of Seizure? You may indeed have to pay something for a failed Direct Debit but £65-28 is taking the yellow water stuff.

      I have never received a Notice of Seizure, and when I have asked when the bailiff was supposed of called was told to "write in"

        If they haven't provided dates, send this in:

        From:
        My Name
        My Address

        To:
        Acme Bailiff Co
        Bailiff House

        Dear Sir,

        Ref: Account No: 123456

        With reference to the above account, Can you please provide me with a breakdown of the charges.

        This includes:
        a - the time & date of any Bailiff action that incurred a Fee.
        b - the reason for the fee.
        c - the name(s) of the Bailiff(s) that attended on each occasion a Fee was charged.
        d - the name(s) of the Court(s) the Bailiff(s) was/were Certificated at.
        e - the date of the Certification.

        This is not a Subject Access Request under the Data Protection Act S7 1998 so does not incur a fee of £10. You are obliged to provide this information.

        I require this information within 14 days.
