I think the OP makes a valid point. sometimes we get used to trotting out percieved wisdom.
I am not saying that what we say isn't correct, but i think that it is as well to stop and think every now and again and make sure we know what we are on about.

To whom are they responsible, in real terms

is there any examples where this responsibility has been demonstrated

can the council be liable for the actions of the bailiff that failed to declare to them they coerced a mentally ill person into signing a indemnity .
