      From a quick read of that page it appears that the Enforcement Co's are either not passing the info on to their "employees" - whether deliberate or not, who knows or telling them to ignore it as it is not applicable and does not matter.

          Hi thanks again, i dont fall into any of these cats im afaid. Although i dont work my car is essential for getting my children to school 1.7 miles away, my car is my main concern.

            You dont really want him turning up at all. Make a Form 4 complaint against the bailiff for cheating with ghis fees. That'll give him something to think about.

            Also, contact to the court manager of the Magistrates court that fined you with a formal complaint.

            I received a enforcement officer on [DATE] collecting an unpaid fine of [AMOUNT] who said was acting on your behalf.

            The officer said I must pay the sum of [AMOUNT OF FINE+AMOUNT FEE] and he said I was liable to pay his fees because of a contract exists between HMCTS and his company.

            I now understand the warrant for distress was issued under Section 76 of the Magistrates Courts Act 1980, where it only applies to Enforcement of sums I am adjudged to pay.

            Leaflet EX345, published by the Court Service says Page 5; they do not charge me for the work they do, and I confirm no distress or sale of goods took place.

            Please send me a copy of the order or adjudgment that was relied upon to place a liability on me to pay the officers fees on top of the fine.

            If no order exists, then I ask this complaint is resolved by:

            1. confirm in writing no such costs order for the officers fees has been made.
            2. remove the fees from the fine
            3. Ensure the person responsible is made accountable for falsely representing to me that I am liable for the officers fees when I am not.

            I will make regular instalments of [AMOUNT] a week from my prescribed benefits starting on [DATE].

              Hi All,

              Just thought i'd keep you updated, i posted the above letters last week. I have recivied a call today from the courts that issued the fine. After a telling off and the threat of prison, they have agreed to except £10 a week till i have paid the original fine of £210 (left to pay).

              As u can imagine im over the moon an would just like to thank you again for all your help, its such a relif to myself and family. So thankyou!!!!!

                I would be inclined to ask why they still say you owe £210. What has happened to the payments that have been deducted from your benefit?
