  • Jacobs bailiffs

    Hello I am hoping somebody can help,Jacobs bailiffs say they only have to provide me with a computer printout when I asked them for all information they hold on me,they are acting on behalf of my local council, I paid the £10 asking fee, they claim that is all the are legally bound to provide because of the Ezsias V The Welsh Ministers (2007) and Durant V The Financial Services Act (2003) could somebody please confirm if this is correct

    Total and utter rubbish. Refer them to the Data Protection Act Part II Section 7.

    Are you by any chance wanting proof they overcharged? If they still refuse to comply report them to the ICO. If they still refuse refuse to comply you can enforce compliance through the courts.

      You didnt need to pay a fee, because a breakdown of their fees is not personal data in the the meaning of Section 1 of the Data Protection Act.

      If a bailiff fails to give a breakdown of his fees then you dont have to pay them.

        You're ahead of me HC! That's why I asked the question, to clarify if that was what the OP wanted. If they want all data, obviously the fee stands.

          Other than a breakdown of fees, what other information would a debtor need to see?

          They dont hold any personal information on debtors.

            Depends on circumstances. I SAR'd the bailiffs who visited us for non-payment of CT and NDR three years after the event. I was surprised the personal information the council had passed onto the bailiffs about me.

            If it is a recent occurence it is hard to see what else it could be, but only the OP knows for sure.

              Thanks all for reply,there is a lot more to it than I explained earlier,went to court over council tax and when the council member of staff put there version to the judges told a lie so I lost the case,because I never had my payment plan letter on me for the year in question, then outside the court room provided all other information to her, 4 wage slips,2 p60's etc and told her have mortgage etc, but would not accept my offer of a payment,and the same afternoon sent the court judgement to Jacobs bailiffs, she infuriated me that much I asked the council for access to my data paid my £10 fee then once I received it I then made a official complaint to her manager,but obviously she took her side ,I then took the next course of action and passed the complaint onto the chief executive of the town hall but now the council are quite they have not responded to the complaint in the 20 working days or sent the letter to let me know it is taking longer to investigate ,I did received the letter saying he would fully investigate,I communicated for a while directly with her manager by E-mail and I even asked her if this was OK to which she replied yes and that she was happy to answer any of my queries but now that has stopped,I think they are hoping I will forget it and go away, today Jacobs said they are sending everything back to the council and not continuing to try and collect the debt, because I let them know there Bailiff broke the law by threatening to enter my house even when I am not there by using a locksmith,I have the letter to prove it

                I missed that bit.

                If you have a document from a council tax bailiff saying they intend to interfere with the locks to your house then he commits an offence. Two offences actually.

                The bailiff has uttered a document purporting to have a breaking order when he hasnt. Section 40 of the Administration of Justice Act 1970 http://www.legislation.gov.uk/ukpga/1970/31

                The Details of complaint would be very simple.

                The bailiff told me in a letter he would return with a locksmith, and I attach a copy of that letter.
