Unpaid Speeding Fine and Bailiffs attendance letter

  • Unpaid Speeding Fine and Bailiffs attendance letter

    Hi
    I came home Friday 13th Jan 2012 to find a (Notice of Attendance ) by Swift's, Saying Removals of goods under Scheduel 4A Domestic Violence,act 2004. Saying if i haven't paid within 24 hours of the letter a Bailiff may force entry. I know they Can by law but how offen does this occur?

    The Fine dates Back from 2002 and i have moved several times since then and to be honest i didn't even know it existed. I had the letter from HMCS and called them straight away and set up a payment plan. I paid one payment on my debt card on the 1st Oct 2011 and i was sent a form to pay the rest by Direct debit.
    I filled the form and thought that was it. I will be honest i never Check my bank balance, so i have never checked to see if it has been going out. More fool me..
    Anyway this is the first thing i know about it!! I have had no letters or anything?

    My next door neighbour also told me on Friday there was a Police officer looking for me, So i did the right thing and called the Police and they had no record of anyone calling at the house. Which to me would indicate that he was posing a Police officer to my neighbour to try and ekk information out of him..

    That i find amusing especially as my uncle is one of the Chief of Police for North Wales .. I cant wait to tell him ...

    I haven't called the Bailiff because i have only jus walked through the door from a weekend away .. I could really do with some advice here??

    And one more thing what is the state of play with Dogs? I have 2 and they have free run of the house and they are big.. I don't want any Harm to come to them so advice there to please ..

    Here is the legislation quoted:

    Domestic Violence, Crime and Victims Act 2004

    How much was the original fine? Does it say how much they want you to pay?

    They cannot force entry without a warrant, and as for the dogs, they will be fine. Would the bailiff?

    I would phone the courts to see how much the fine outstanding is - it may be different to what the bailiffs are claiming.

    Are you in a position to pay them?

      Hi thanks for reply it has put my mind at ease a little.

      So how would i know if there was a warrant ?
      And do they normally leave it a few days before returning if they have a warrent ? and i am in a postion to pay what was owed to HMCS well a massive chunk off any way,but the letter i was £300 over the original fine ..

      I don't want my door coming off at 7 am tomorrow morning. And the dog are pointers,so pretty big and will stand there ground if put in a situation that involves me or strangers to the house if im not about

        Its very rare. This is Marston/Philips MO to hide behind the Domestic Violence, Crime and Victims Act 2004. It only provides bailiffs with immunity from prosecution from committing assault. It provides no immunity from liability under the Personal Injury Protocol.

        Contact the Court manager and tell him that, and ask him to put it right. If he wont, then start the complaints procedure for failing to issue a sommons to appear before the court, to your current address. Cite Section 7 of the Interpretation Act 1978 if you need to.

        I wouldnt worry about dogs, provided they are not a banned breed under the Dangerous Dogs Act. Just leave the door or gate shut.
