  • Attendance and Removal fees

Can I be charged Attendance to Levy and Attendance to Remove fee in one visit when a letter is pushed through my door when I'm in? There was no lorry to pick up the car or clamp on it.

This looks like an unpaid parking ticket.

No, you dont have to pay them because the bailiff is charging for work he has not done.

The bailiffs attending fee is prescribed. - 28% of the PCN.

Definitely can't claim both in one vist as HC rightly states. Could you just confirm if it is a parking ticket please. :beagle:

Its a parking ticket because the bailiff companies MO is to send a bizzy-body, who is not a certificated bailiff - to go round and stick the note throught the door. He cant knock the door because he does not hold a bailiffs certificate.

Its illegal because a visit fee can only be done by a Certificated bailiff calling at the property. The company is guilty of charging for work not done (attending fees), and the bizzy-body commits an offence for charging for a visit which only a certificated bailiff can do.

Yes it is a parking ticket the guy showed up in a van pushed the notice through my door and he didn't show his ID, I stupidly didn't ask to see it because I locked my two year old in the house in my haste to challenge him. Luckily the little tyke had figured out how to open the front door.
I was charged 191.44 outstanding, 62.44 for the attendance to levy and 210 attendance to remove.

I wanted confirmation as it is far from unheard of, as you will know, for a certificated bailiff to perform similar antics.

I paid 50% as he said the lorry would turn up at any time. How do I go about getting my money back or contesting the amount?

Phone the bailiff on his mobile and ask what court issued his bailiffs certificate. That will confirm he is indeed, certificated.

If he asks why you need to know, just say you want to make a formal complaint about him overcharging you with his fees. Expect to get some stick from the bailiff over the phone, so quickly ask him to return the money you have been overcharged by the end of today.

The only bailiffs fee he can legally make you pay is 28% of the PCN, and £11.20 for the letter. He cant charge you any costs of distress because none was made.

                Do the arithmetic.

I'd be surprised if you get your money back today - I sincerely hope I'm wrong. If you don't either post up again, or have a look at the Stickys in the bailiffs' section to find out how to make a formal complaint.

Bailiffs drop a brick when they get wind a Form 4 complaint being made.

I've watched them at my own house - it's good viewing!

There are no contact details on the letter, just JBW details

This is JBW's MO, they will go for your car, and without knowing who the named Bailiff in Charge is, you cant even make any formal complaint.

Unless you have grounds to appeal the PCN, get it paid with the council.

I wouldnt worry about the bailiffs fees, the work hasnt been done.

Phone JBW on Monday and ask for the name and details of the bailiff that attended your property today. Ask for his number and then phone the bailiff asking for the details given above, or ask JBW to refund the illegal charges immediately or you'll be complaining to the Local Government Ombudsman.

Just to add to the advice already given, if possible try and record the call as Bailiffs have selective memories.
