Hi there, I was just wondering whether anyone out there could kindly give me some advice on this issue.
We travelled to Birmingham last November and parked the car on single yellow line (no sign posted restricted control zone) on a Sunday. We received a PCN and subsequently filed informal appeals to the Birmingham City Council within 2 weeks but it was declined; we then filed the formal representation after received the NtO in January this year and heard nothing until we moved house in April, we therefore assumed the PCN was cancelled.
On 29 November, my partner travelled to Southampton to vist a client. An hour later, she found her car got clamped with a note left on the windscreen which asked her to contact Equita. She didn't know what to do so asked me to deal with it.
After long conversations with this Equita guy as well as someone at the Birmingham City Council, I had to pay £430 from my own debit card to Equita in order to get the car released. Regardless I paid the fees this guy issued a handwritten "invoice" address to my partner with no breakdown of the charges at all!
From the conversation with the guy at the Birmingham City Council, I was told the bill left the Council at just over £100 (although we argued we shouldn't pay for this either given their slow response and kept sending the correspondence to our old address), however, Equita has added another £300ish as their "Bailiff Fees", which I would consider to be excessive.
The question for now is that as my partner is the registered keeper of the vehicle, although I paid the charge from my own debit card on her behalf, will I be able to deal with equita myself or shall I arrange all future correspondence to be sent from my partner?
Any advice would be gratefully received.
