Non Certified Bailiff C Ollecting Parking Fine !!!

HI,seeking advice on a bus lane contravention.Recieved a bus lane pcn from bradford council back in may.Forgot about it and then had a bailiff at the door while i was out,from PHOENIX DCA BOLTON.Usuall letter asking me to ring him to sort this debt out.Rang the guy and asked him to give me a month to get £140 together.ok he said pay me on the 7th dec.In the meantime i contacted phoenix and offered them £10pm.Got a reply stating they would only accept £40pm.The next day i got a statement of account with a "bogus visit fee added"adding another £40 to the account.Rang the bailiff and asked why he had been to my property again,to which he replied "he hadnt been".He then got "Agressive"and said i had "GONE BEHIND HIS BACK" offering to pay phoenix directly??.This whole episode has sickened me that much i want some justice over my treatment.I have just found out the baillif was not certified at the time of my visits and has no certification pending(cert ran out on 22/10/11.What shall i do next as im sure the guys a fraudster and would of nicked my card details when i rang to pay him.Help please.

In case you haven't already, it could be worth phoning the Ministry of Justice - 020 3334 3555 - to check if the Bailiff is certificated, as the online register isn't always up to date.

I have just found out the baillif was not certified at the time

But he has been subsequently certified as insane?

I'm sorry but I don't know enough about PCN's to be able to help you. I'm sure someone more knowledgeable will be along shortly.

Yes thanks anyway mrs james.It seems i will get no where as its a government clawback(stealth tax)and they all p**s in the same pot.It seems normal for these people to lie and get away with it.Im sure ill find a way to claw the money back though !!

Not paid any money to said bailiff,gone direct to phoenix and offered installments.As i said in my previous post,i feel as though you just have to bite the bullet and let them"RIP YOU OFF"with bogus fees.Even the dedicated certified bailiff helpline has said the guys not registered,but phoenix are giving me start and expiry dates of his certification etc????How far do you go before giving up and moving on ????

It explains very clearly the procedures that should be followed for a PCN if it is being treated as a criminal rather than a civil matter. Have the correct procedures been followed?

Is the matter being dealt with by a county court or a magistrates' court? I know which I would think, but just want to check.

Thanks labman.The case went to TEC Northampton,and i didnt appeal and then the bailiff turned up.Civil matter but i feel as though the system wants me to feel like a criminal.Never thought i would be hassled like this for driving in a bus lane.!!But such is life at the mo.Revenge will be sweet.

I assume from your comment above that you knew you'd driven in the bus lane and are indeed guilty of the offence?

So on to the next questions - sorry! Has the bailiff at any time left solid evidence with you that he is working for Marstons(-eg-has he posted a card through your door with his name on it?), or do you need to get written proof that this is the case?

Are you aware, as you have not paid anything yet, what fees have been applied, and what these fees are for?

Please answer both these questions as your response will alter the way forward.

Yes your honour im guilty !!on camera!!couldnt pay at the time as i was skint and had a bad attitude due to being self employed in the building trade in this bizzare climate.2)yes left headed notepaper from phoenix with his mobile number on.3)I have paid one installment to stem the tide!!4)Fees include one letter fee and 2 visit fees(one bogus but they reckon they have tracking records from the bailiffs vehicle to prove he visited)
