      I doubt it, that would imply we are singing from the same hymn sheet, which we clearly aren't , and of course the difference between "I think" and "it would have been".

      When the OP posts again hopefully we can get the confirmation of the situation re the fine etc from her.

          Administrative proceedings count under procedural law as court proceedings, so for the magistrates to instruct the bailiffs to collect the fine there surely has to be administrative proceedings.

          "Procedural law or adjective law comprises the rules by which a court hears and determines what happens in civil lawsuit, criminal or administrative proceedings."

          "The magistrates court will instruct private bailiffs"

                No problem, at least you're trying to learn.

                We cannot know for sure until the OP posts again, but if the driver was stopped by traffic police their car would more than likely have been fitted with an ANPR camera. The car would have been flagged up immediately as not having a valid tax disc. An FPN would then have been issued.



                As above and based on what the OP wrote, I believe this to be the case.
                Hi post 1 the tax disc was 2 days out of date in September.And know way could you read the registration as the sun had damaged it.:beagle:

                    the police did not give my husband a fixed pen ticket he just said the tax disc had been voided by the post office because they had written the wrong reg number on it, but we havent had one letter regarding this matter just a visit from the bailiffs

                      Have you complained to the DVLA yet, as Amy suggested in post #4? If not that's where I'd start personally.

                        it is the dvla that has fined my husband for driving without a valid tax disc, but he must of been driving round for 6 months not knowing as he drives into a police station every day. I rang the dvla a couple of days before the tax was due for renewal to say we had not received our sorn thingy, they didnt mention a thing they just told me how to tax the car without it, then a day or so later he was stopped by the police, the policeman never issued a ticket just said the tax disc was voided, and we didnt think anything of it until the bailiff knocked then we put two and two together, now £95.00 road tax is costing me £750, and i cant afford to pay all in one go 4 weeks before christmas, ps it is a magistrates fine does anybody know if they will let us pay monthly while we appeal

                          So, just to be 100% certain - apologies, the police stopped your husband on a motorway for not displaying a valid tax disk and let him off completely without any penalty, paperwork, telling him x,y or z was going to happen. They just let him on his way driving an illegal car?

                            The disc was only 2 days old.And he is a policeman.Old pals act.
