  • private bailiffs issues

    i've got a debt with hfc not been able to pay and now they ahve a charging order . recently the account has gone back to court for enforcement and they are threatening with bailiffs. what powers do these guys have compared to those collecting fr council tax. and what are legal charges . I am remortgage=ing at the moment and should be able to settle in few weeks .

    Obviously you have a CCJ. They can apply to the Court for a Warrant of Execution - cost £100 which is added to your debt. This is for the County Court Bailiff to attend you, he will write to say when he is coming and how much he is expecting you to pay. The Court Bailiff is usually a different animal to those you read about in other threads.

    He gets paid a salary and not on results. He can be more amenable to deal with and will listen to reason. However you should still deny him entry to your home - he has no automatic right of entry. If you have a car it should be parked well away from your home. Essentially if you can prevent him gaining a levy or otherwise seizing goods outside he will be powerless.

    Of course if the debt is for more than £600 then they could transfer it to the High Court for enforcement and end up with a visit from a High Court Enforcement Officer. The HCEO will give you no warning of attending until the day he knocks on your door and the charges they they apply have to be seen to be believed.

    Have you thought of applying for a Variation Order where payments may be set by the Court?
