• Bailiff fees and general issues

Hi. here is my question:
I've had stuff impounded by bailiffs for council tax by North Somerset Council and Rossendales for this year (2011 and a total of £1154). I've asked for a breakdown of the fees they have charged, and they have supplied the following (And my comments):

Aug 1 2011 £24.50 Visit fee. (No such visit was made.)
Aug 25 2011 £18.00 Visit fee. (Again, no such visit.)

The reason I KNOW there were no visits was because my wife was critically ill in July, and was released near the end of the month. From then on, for about 10 weeks she was virtually housebound. I also work(ed) from home, so the house was permanently occupied. NO letters were put through the letterbox, nobody came calling, etc. etc.

Sep 2nd 2011 £58 Levy fee. The bailiffs (Who DID arrive on the 2nd) saw these items while we were chatting at the door. They are listed as: Hall mirror, hallway carpet, roller blind, selection of wall pictures. Firstly, I DO NOT HAVE roller blinds. Secondly, My HALLWAY is parquet flooring, not carpeted. So this strikes me a rubbish.

When everything kicked off on the 13th of October, the bailiff put fees of £415 on the bill for “other” fees.
In their breakdown of fees, Rossendales list this as:
£175 Attendance / Van fee
£180 Removal / Tow

Now, I may be dumb, but that does not add up to £415. Also, the “tow” was on a vehicle I did not own.

So, first off, is this a rip off?
Secondly, is there something where I can get a list of fees that are legally chargeable. I’m really looking for something with a .gov on the end, to have some authority on the matter.

Thanks.

Doug.

Yes there is something you can do about it. Write a letter to the Head of Revenues outlining the unlawful charges which sounds to be all of them, as any that could have possibly been legitimate are negated by the fact that no levy ever took place. For this to happen they would have first had to have gained peaceful entry to your property.

In terms of the Schedule of Fees you want you need to read Schedule Five of this legislation THE COUNCIL TAX (ADMINISTRATION & ENFORCEMENT) REGULATIONS 1992
AS AMENDED BY THE COUNCIL TAX (ADMINISTRATION & ENFORCEMENT) (AMENDMENT) (NO.2) REGULATIONS 1993,
THE COUNCIL TAX (ADMINISTRATION & ENFORCEMENT) (AMENDMENT) REGULATIONS 1998,
THE COUNCIL TAX (ADMINISTRATION AND ENFORCEMENT) (AMENDMENT) (NO. 2) (ENGLAND) REGULATIONS 2003
AND THE COUNCIL TAX AND NON-DOMESTIC RATING (AMENDMENT) (ENGLAND) REGULATIONS 2006

To save you having to hunt, you can find it here:

Hi.
I have proof bailiffs lie.
Have a look:-
Proof of incompetence (Rosendales) - Legal Beagles Consumer Forum

I am currently compiling evidence of fraud and negligence. I intend to publish my findings here soon.

Good luck David.
