Surely in these circumstances it is a case of the account holder having the onus on them to be aware that banks can, and will, cash post dated cheques. Ignorance of the law is not an acceptable plea.

I'm not talking about post dated cheques - just cheques written when there are insufficient funds to meet it.

If a cheque is not supported by a cheque guarantee card then it cannot be accepted on a guaranteed basis.
