  • Urgent Bailiff Due To Take Car But Letters Are In Wrong Name

Hi I was wondering if someone could give me some advice on my problem...I received 2 parking tickets within a week of each other about a year ago I am unemployed due to the fact Im mentally disabled I have Bipolar and ADHD anyway I couldnt afford to pay either of them and because Ive been very unwell this last year I will admit I have just tried to forget them as it was all too stressful.
Anyway I have been receiving Letters from Equita but they are addressed to the wrong surname I think this is because an error was made on my registration documents a long time ago...I have re registered the car since the parking fines occurred in my correct name and when I sent the registration forms off I actually filled it in wrong and did it as a change of owner instead of change of name. So the car is now registered to me but in my correct name as a new owner.
What I would like to know is this...if these warrants have been issued in the wrong name and the letters Equita are sending are in the wrong name can they still take my car as it is registered to my correct name now and was registered after the parking tickets were issued so in a way its like the car has changed hands.
Also as they have the wrong name does that also mean I am not liable for the debt so they cant take any of my belongings either??
Id really appreciate if someone could get back to me ASAP so I know what to do when they show up.
    Thanks in advance

When you say an error was made a long time ago I am puzzled. Was it registered in your maiden name perhaps? Did you register it in someone else's name for a reason, but using your own address? What exactly was the mistake?

If you deliberately set out to mislead the DVLA and anybody enforcing penalties against the vehice, then this could potentially have serious consequences. If you could clarify how the car came to be registered in the wrong name it would be helpful. I would imagine when you got the registration document back you would have noticed, so why was the error not corrected then?

It was from when my car was towed about 2years ago I was away from home and didnt have my registration docs on me so when I went to pick it up from the compound they completed a new registration document for me I think that was when the error was made...anyway When it eventually came through the post I just didnt bother looking at it closely as I already had my original registration document anyway. It was only when my Tax Disc reminder came through with the wrong name on that I realised there was a problem they spelt my surname totally wrong. So I looked at the form then and saw the error so I quickly filled it in and sent it off to change the name to the correct spelling but I wasnt well and I get confused easily when Im like that and didnt realise till Id got the new registration document back that it had put me as a new owner not a change of name. I havent done anything intentionally to avoid paying the fines...I just simply dont have the money to pay for them I get £150 a week to support me and my grown son on my dad has to pay a lot of my bills for me because I cant afford to so these parking fines are just something I cant afford to pay but I rely on my car to get me to hospital appointments for my illness and if I lose my car I will be left isolated and unable to get around and I honestly dont know what effect that will have on my mental health...stress triggers my illness very badly..

Yes they can still take it, they are using the name you gave them, so this won't make any difference.

More importantly, who gave you the fines, how much were they originally and how much are the bailiffs attempting to charge you?
