    Hi KData, and I am sorry for your loss. FWIW, I believe such losses to be only temporary - or temporal - but that is not a discussion to be had here - it is simply my own way of dealing with such inexplicable pain.

    I'm glad to see that you're getting help from those here who can give it. From my unlearnéd standpoint, may I convey my view. Please bear with me - I'm trying to think outside of the box you're in, right now.

    It seems that you were 'done' for driving a vehicle with a defective exhaust and number plate a while ago, by a Police Road Traffic Officer, and lawfully issued with a ticket of some sort to that effect.

    It seems that you COMPLETELY IGNORED to respond to this ticket, and probably to subsequent requests to deal with it.

    It seems that you are nothing more than an irresponsible boy racer who really doesn't give a monkey's, and thinks he can get away with doing whatever he wants, by simply ignoring the Law.

    If you're still reading, then I guess you are now quite angry - but if you're still reading, then you are clearly prepared to listen to what you may not want to hear. In that case, you seem to me to be a reasonable man, sir.

    May I now ask you to notice that I have used the phrase "It seems..." in the above comments. I haven't said, "It seems TO ME..."

    If you're still with me, mate, the point I am trying to make - and probably very clumsily - is that I feel that the above impression is what the "Legal Machinery" has of you. I respectfully ask you to try and put yourself in their position. What I have said above is perhaps what seems TO THEM to be the person you are.

    ...and with the utmost respect and heartfelt sympathy, I feel I have a better idea of your position than perhaps they have - as do us guys here. You are QUITE CLEARLY - a much better person than that.

    What I am trying to say to you, KData, is that - perhaps - if you could make it clear to Marstons, and all who have a say in this, that you have suffered a loss far greater than losing a silencer and a piece of perspex, and that you have been unable to respond respectfully to their lawful requests, due to this - then they may at least find something in what you are saying to give them good reason to back off a little.

    There are still human beings operating within this machinery, mate - but you have to appeal to them sometimes. I guess I am saying that you need to make it clear that you accept that your recent loss has not given you immunity to the law, but that your circumstances might just allow them to be lenient in imposing further charges...

    You may need to provide paperwork to support your appeal for such leniency. PLEASE - do NOT let them make you feel as though you are "USING" your dear Son's departure for this. It is nowt but a "REASON." And you are being reasonable, are you not, good sir ?

    I apologise if I have offended anyone here. Just trying to help in my own way.

      Thankyou bill k. And yes once appon a time I was a il regarding boyracer who had no care for the law but my life has only given me that choice as I only know the wrong way to deal with things but since meeting my wife she has some what matured me and helped me to fit in the world a bit better so I take no offence in your.comments they are the old me .

        Datak, here is another guide to dealing with magistrates' court fines which you cannot afford:

        It contains a template letter (the last page) for writing to the court to ask to pay in installments/smaller installments, which should be accompanied by the Income and Expenditure sheet as per the previous posts.

        I would suggest you expand on this letter as much as you can about the difficulties in your circumstances, and enclose copies of the certificates of both birth and death of your baby son.

        You will need to explain as best you can any reasons why you have not dealt with the fine sooner.

        I would suggest you add to the standard letter,

        'I would be happy should it assist the Court to appear before the magistrates to address them as to my circumstances or other relevant matters. For compassionate reasons, I would ask that the Bench consider setting aside all or part of this debt. If this should not be acceptable, I can alternatively pay by installments at the rate of Łx per week/per month.'

        If you do have to go to the court, take some cash if you can, even if it is only Ł5 or Ł10 and offer this as a part payment (and get a receipt).

          Soz for being a bit 'snooty,' there, KData. You remind me of ME a few (more than a few, TBH) years back. I've got 'TWOC' on my record, and I currently have 10 speeding points on my licence - but I must admit I haven't lost a child like you have.

          If you can deal with the cr@P I just dished out to you, then you can deal with the high quality advice that others such as SpringerSpaniel have to give you.

            You should also let the Bailiffs know eg by fax that you are making this application to the magistrates court.

            Another member with a similar situation found the court put recovery action on hold for 2 weeks once he went into the court office.

                How much was the original fine and do you know how they have arrived at Ł640?

                Magistrates' bailiff fees are capped and the capped figure is nowhere near what they are attempting to charge you.

                SpringerSpaniel is correct in that you should apply to the court for a means enquiry hearing, however, the installments (if they agree to this) will include the nefarious charges they have added.

                So you really need to find out what the fees have been added for. You should send them this letter Bailiff - SAR - Legal Beagles Consumer Forum

                With regard to the bailiff being certificated or not, you need to call the Ministry of Justice to check this since the online list is not always up to date. Call 020 3334 6355 between 10am and 4pm and ask them to check his details for you.

                  It seems to be patchy, as it does include a Mr Cowley whose certificate dates from 11 May 2011 but not this Mr Cameron who claimed to have a certificate issued in April 2011.

                  What use is an on-line register if it is not kept up to date?

                        Hi everyone sorry i have not posted in a few days its been hectic at home.
                        Casper has done me a cfs, i have also use the template Springer done for me and i am now writing a letter to the courts they shall be in the post tomorrow morning.

                        Im faxing a the s a r to Marstons tomorrow also so hopefully fingers crossed everything shall fall into place.
                        Once again i appreciate all the help

                                No, it was issued by a steatopygous magistrate (if you'll pardon the tautology) because of an unpaid fine.
