marston bailiff help needed

    Hi all I have a slight problem with a Mr Cameron from marstons
    I have according to them an unpaid fine from last year something to do with my numberplate not bein on my car and a load exhaust
    I am told I ow them £640 which I think is unreal
    I recieved a letter the other day saying he came to my adress to take my belongings
    My wife and I are grieving at the loss of our baby son and I'm just about managing to work
    It's a struggle to even buy food let alone pay this
    I contacted him to make payment arrangements and he told me it was no good
    He then told me he would turn up to my address with a locksmith and police and remove my stuff.
    My wife is living in fear and we don't know what to do could any one help please

      Thankyou yes I read the sticky.
      I'm just in need of some direction in the best way to deal with this and am uncertain if my offences are serious enough for the bailiff to enter my home

          I am also sorry to hear of your loss, and of your difficult circumstances. I have also lost a son in infancy.

          Is the fine from a magistrates' court/ the police or alternatively is it related to an unpaid PCN ?

            I'm sorry for your loss too springer.
            I knew about the fine as I recieved it on the day from an officer of the road traffic team.
            So I'm guessing its from magistrate court as I failed to pay. Also I checked the bailff regester and Mr Cameron is not on it. He told me he was done at ipswich on the 19th April this year.

              For what was the oaf done - for claiming to be a bailiff or for impersonating a human being?

                  If this is a magistrates fine, then unfortunately the bailiff does have the power to enter your home. It is very rarely used, but you must make urgent arrangements to pay the fine.
                  What isn't clear is how the fine has escalated, that will need addressing, but for the time being you're going to have to prioritise this debt.

                    Do you have any papers related to this fine which you can remove personal info from, scan and post on here ? This would help people to advise you better.

                      Thanks everyone. Ok so I have to pay, how am I goin to get them to agree to an affordable amount. Can I take this back to court or stall it to allow me more time.

                        I'm planning to post on this thread with more advice tomorrow when I've had the chance to check up a couple of things.

                        There is a procedure to apply to the magistrates to pay the fine in manageable installments. You will need an income and expenditure sheet, so you could start working on preparing this. These are downloadable ones on this site.

                        If there are any unreasonable / unlawful fees charged by the bailiffs, you can dispute these and get the total amount down - I would suggest you send an SAR to the bailiff company. The site's bailiff guide should help you too.

                          Yes I have the letter he posted in my door on the first visit I will try upload it but I only have internet access via my mobile phone

                              There is another guide here.

                              You can apply to the Fines Officer at the court which issued the fine for your payments to be made in installments and/or smaller installments if your circumstances have changed. You need to explain how your circumstances have changed and provide the income and expenditure sheet.

                              There is a risk you should be aware of that they may seek an Attachment of Earnings or Attachment of Benefit Order in respect of the fine.

                              You may be referred back to the magistrates about this matter. The guide suggests that you could be ordered to spend the rest of the day in the court and that this will write off the fine - this might perhaps be easier in your circumstances ? If so, if you appear in court, you should ask for this to be done. You could also be asked to / ask to do unpaid community work instead of paying the fine.
