    Hi, i have two liability orders from stafford borough council and the problem i have is that i have is, i had arranged to pay back £20 a week in a stacked arrangement, which i payed the first on on time but paid the second payment late but was still accepted. Then when i came to make the subsequent payments it said that it had been referred to the bailiff and i had to make all dealings through him. i then recieved a bailiff removeal form in my letter box on the 3/8/2011 saying that i had 24hrs to make full payment of the balance which had rocketed from £395.50 before his visit to £562.50 after his visit(there is no breakdown of charges to explain his £167 hike in costs).
    so i phoned the number to explain that i had an arrangement in place albeit i was a little late in paying but was goin to pay what i owed to get back in line with my arranged payments, but he just said there is no arrangement in place now and that he wanted payment in full and that i only had days and not weeks to make payment. i told him that i couldnt do it, he just said i would have to borrow it of somene then pay them back. i told him that was not an option but he said he would be coming for my goods, which his where my big problem lies, i got fooled by a different bailiff before and i let him in as he said it was about making arrangements about paying weekly and i signed what i thought was an agreement to this. i now know it was a walking possesion form.
    but im not sure what happens because the bailiff removal form he posted has a different rossendales ref number than the walking possesion order that i signed. the money he his requesting is for the first liabilty order i got and the walking possesion order is for the sencond liability order.
    so what do i do? he is saying that he can break in even tho its not the account that the walking possesion order is for. i dont want to let him in to save on damage he my cause by forced entry(i live in apparment block with a comunal entrance so would have to pay for two doors ro be fixed/replaced) to find out ive been fooled again and then end up with another walking possesion order.

    i managed to buy a little time with him, i have got to phone him tomorrow(monday 8th aug) to arrange payment for thursday. i am in court though on tuesday morning filing for bankruptcy so was also wondering where i stand with the walking possesion order when im bankrupt?
    he also says my car has been noted even though there is 25+ cars where i live and i was at work in it the day he posted the letter.
    so pleas any advice would be great. i have read the bailiff guide but i cant get the answers i require from there. i also have spoke to national debtline who were very good and understanding but they were not very clear on the dilemma i have posted above.

    When you are made bankrupt, my understanding is that all debts are written off. The bailiff problem would then pass to the official receiver as s/he will have control of all your assets. If some of your assets are under a walking possession order, it wold be for the OR to resolve what happens to them.

        Hi Mart,

        Thanks for your PM. To answer your questions, council tax debt in its entirety is not automatically "written off."

        As for the walking possession order, if it was gained for a previous liability order then they are not permitted to use the same walking possession as a means of entry for another liability order.

        Separate liability orders mean separate charges - separate everything in fact.

          Amy is right. CT debts I believe are written off from previous years at your bakruptcy, but you will be liable for anything remaining. If you've been served with a liability order or final demand for the current year I think that is written off too.

          Can anyone confirm this please?

              Thanks you two, your advice is greatly appreciated . This forum is a godsend. cant believe some of the lenths bailiffs will go to to get their money. i was only a few days late with the payment for arrangement i had made and then i end up with some jumped up idiot demanding payment in full within 24hrs, does he not think that if i could get that sort of money in such short time then i'd need a payment plam in the first place. one word comes to mind "HELMET"!!!!!!

                Sadly, that is the way most bailiffs seem to work. Once a repayment plan is agreed it is cast in stone with no room for any leniency whatsoever.
